International standards demand that governments announce election dates 120 days or 4 months ahead of the actual day. And there are only 70 days left till the ‘supposed’ day (June 20, 2007) of constituency assembly elections.

We agree that the elections in India are not the most democratic affairs and booth capturing and vote rigging is a common practice but why is the Indian government so adamant at having elections in Nepal when the latter country is going through a virtual civil war? Why is Indian government so adamant at having a ‘legitimate’ puppet government in Nepal which doesn’t even carry any popular support? They already have a government currently in Nepal which is toe-toeing with them. Why is the Indian government ready to accept the elections when the UN and the US embassies and even the Nepali politicians (of criminal SPAM parties) have accepted that these are ‘Abnormal circumstances’ and the voting would be Abnormal? When there are gun trotting gangs roaming freely and intimidating people no elections are going to be had in a ‘free’ and ‘fair’ manner? Nepal is under a virtual civil war with murders and extortion taking place rampant. The Constituent Assembly elections are supposed to be a decisive phase in Nepal’s history and if these elections are not held in ‘free’ and ‘fair’ manner than the entire foundation of ‘Naya (new) Nepal’ (that the Indians and SPAM parties of Nepal) want to make will be illegitimate and weak. When there are the gangs of SPAM parties roaming around freely around the country and threatening everyone that even raises a voice to question them, how are the elections going to be held fairly? So does the Indian government just want that the people (being intimated by SPAM) go out and vote for the SPAM parties without knowing what their ‘manifesto’ is? Around 80% of the electorate in Nepal doesn’t even know the meaning of ‘constituent assembly’ and yet the Indian government is Desperate to have elections in Nepal! If they just want the elections for the ‘Sake’ of it than why are they evening making such a ‘fuss’ because of which Nepalis are getting killed everyday? Why don’t they just go ahead and have elections Now, so that the killings stop and we Nepalis for once start accepting ourselves as the 36th state of India!

Not only the above, the Indian government goes on to say that, Nepal could set its own examples in this regards as it had done during the peace process. How Democratic of you Honorable Ambassador. If you mean the ‘Peace’ process in Nepal has indeed taken place we would ask you to drop the ‘terrorist’ charges against the ‘Kashmiri’ insurgents or the ‘Naxalites’ and make peace with them. Here you are forcing us to accept the terrorists (funded by you) hook or crook and you wouldn’t do the same in your own den! These terrorists kill us day in and day out!

The entire Internationally accepted principles of elections are going to be thrown into the dustbin just because India and SPAM parties want the elections in these ‘abnormal’ circumstances…

How can a Democratic country like India say that SPAM parties can do whatever they want? There is Nepal beyond SPAM parties and we need to act freely and independently to decide our Own future.

Perhaps India (Indian National Congress) is too desperate to have ‘legitimate’ puppets in Nepal and too desperate to get rid of ’anyone’ that questions it’s hegemonies in Nepal.

We call upon you Honorable Indian Ambassador to Nepal, Mr Mukherjee, to accept some ‘Democratic’, ‘Ethical’ and ‘Peaceful’ principles and allow the Nepalis to decide their own fate in ‘Free’, ‘Fair’ and ‘Fearless’ manner. Such comments coming from the mouth of a ‘Responsible’ country doesn’t suit, especially when the entire world is thinking the opposite.

KATHMANDU, April 11 – Indian Ambassador Shiv Shanker Mukherjee Wednesday said that Nepal could “set its own example” on the issue of holding timely elections to the Constituent Assembly (CA).

The Indian Ambassador’s statement comes amidst comments from some diplomatic corps in the capital that holding of the CA elections by stipulated time was not possible, and that the election would lose its credibility in front of the world community, if held forcefully.

Talking to reporters after a meeting with Prime Minister Girija Prasad Koirala this morning, Mukherjee said, “Finalising election policies to meet international standards is not a priority issue” adding that Nepal could set its own examples in this regards as it had done during the peace process.

He further clarified that the Indian government would “support and assist” whatever election date the eight parties decide on.

Indian Embassy spokesperson Gopal Bagle informed that the meeting had discussed the latest political developments in Nepal and the challenges that lay ahead.

CPN (Maoist) registered at Election Commission

The CPN (Maoist) registered itself at the Election Commission (EC) Tuesday to participate in the upcoming constituent assembly election.

A team of Maoist leaders led by second-in-command Dr. Babu Ram Bhattarai went to the EC to registration application for party registration. Maoist spokesperson Krishna Bahadur Mahara, who is also the Minister for Information and Communication, central leaders CP Gajurel, Dina Nath Sharma, Khim Lal Devkota, Agni Sapkota and party activists were in the team.

Talking to journalists after submitting application for party registration, Dr. Bhattarai said that the CA polls must be held in the stipulated time. He added, “Our party will launch publicity campaign for the CA polls from today itself.”

On the party’s election symbol, Dr Bhattrai only said the registered symbols could be ‘revised’.

Commenting on the provision of submitting 10,000 signatures for the purpose of registering new party, Dr. Bhattrai said the provision was brought as a party without the support of 10,000 people should not be considered a political party.

Ruling eight political parties have agreed to hold the CA election on June 20, but the government is yet to formally declare the election date.

This is the first time the Maoists have applied for the registration at the EC after they launched their armed movement from 1996.

Maoists have joined mainstream politics and have joined the interim parliament and the government following the success of the April movement.

The party could not submit the application on Monday, as its leaders Ram Bahadur Thapa ‘Badal’ and Barsha Man Pun ‘Anant’ did not have citizenship certificates.

The two leaders acquired Nepali citizenship certificate from the District Administration Office of Kathmandu on Monday.

NHRC records 640 cases of human rights abuses in four months

The National Human Rights Commission (NHRC) has recorded 640 cases of human rights violations including murder, abduction and disappearance within a period of four months – from October 31, 2006 to February 5 this year.

A NHRC report publicised today says that out of the total 640 recorded cases, 123 people were killed – 86 by the security forces, 30 by the Maoists and 7 people by others including the two factions of Janatantrik Terai Mukti Murcha (JTMM). Most of the murder cases occurred in Terai districts like Bara, Sarlahi, Morang, Sunsari and Dhanusha.

Similarly, 65 people were abducted by the Maoists during the four months period while the security forces were responsible for disappearance of 65 people. 20 people were abducted, or involuntarily disappeared, by other groups.

According to the NHRC report, 66 people underwent torture – 32 by security persons, 27 by Maoists and six by others. Likewise, 57 people were displaced due to Maoist threats. The Maoists seized properties of 41 people during this period.

Other cases of human rights violation include threats, mistreatment and exploitation of children and others.

Speaking at the programme organised to publicise the report, NHRC secretary Dhruba Nepal said human rights violations continued despite the signing of comprehensive peace accord.

Nepal said both the government and the Maoists must work seriously to end the culture of impunity. He also demanded that the government appoint senior officials at the NHRC as early as possible. nepalnews.com mk Apr 02 07

Maoist MP brags about his pistol

To the discomfiture of other lawmakers, a Maoist MP bragged that he was still carrying his pistol during an all party meet being held in the parliament secretariat.

Lokendra Bista, Maoist MP, boasted that he had a pistol in his pocket and claimed it was already registered by the UNMIN. Bista dared others to take action against him.

At the meeting convened by Speaker Subas Nemwang to discuss camp management, Bista made un-parliamentary remarks compelling Nemwang to intervene and ask him to watch his words. “I hope the overfed pigs will not have to be thrashed,” Bista said at the meeting.

Bista’s words also forced Home Minister Krishna Prasad Sitaula to seek apology from the lawmakers. Later, Maoist spokesperson Krishna Mahara told journalists that Bista used such words by mistake.

Gularia tense after Maoist attack victim dies

KATHMANDU, Feb 26 – Gularia remained tense following the death of a person who was injured during an attack by the Maoists on Sunday.

According to a local Ram Lal Yadav, one Zileram Yadav of Gularia-3 was injured in a Maoist attack while attending a marriage procession.

Yadav had died Monday morning while undergoing treatment in India.

The body of the deceased was brought back to the district hospital for post mortem from Baharaich, India, where he was undergoing treatment.

Meanwhile, Arun Kumar Yadav, who was also injured in the attack, is out of danger now.

As soon as the news of the incident spread, the hospital premises were thronged by worried locals. The police have heightened security in the premises to avoid any untoward incident.

Meanwhile, Bardia was affected on the second day of the indefinite strike called by the Madhesi community demanding the release of a local Kittu Yadav. Yadav, who was accused of murdering a local Maoist Madhesi leader Nankau Godia, was taken into police custody on Thursday.

Due to the banda, shops, businesses, transportation services and factories in the headquarters Guleria are completely shut.

According to the police, vehicular movement on the east-west Mahendra Highway and the Nepalgunj-Guleria road has been completely halted.

On the other hand, Maoists allege that it is a “conspiracy” to foil the mass meeting to be held tomorrow in Nepalgunj, which is to be addressed by the Maoist chairman Prachanda.

Although, we believe that a ‘Federal Nepal’ is another disaster…this article makes for an interesting read. I have followed the writers article since long and she writes correct things from the Macro point of view. The Macro level problems are, correctly, well defined and illustrated in all the articles by writer. From the micro point of view it is on us Nepalis itself to decide how we want the things to work.

The only thing that the writer fails to understand is that SPA is not a part of the solution but a part of the problem.

Shifting the goalposts

The stoning of King Gyanendra’s cavalcade on the auspicious occasion of Shivaratri, supposedly by egalitarian Hindu devotees objecting to the custom of royal precedence, suggests growing Maoist fears that the forthcoming election to the Constituent Assembly may not give them a winning mandate. Reports from Nepal indicate that the institution of monarchy continues to exert a mesmeric influence over ordinary people in the Himalayan kingdom, and the prospect of its abolition may be eroding the Maoist grip over popular imagination.

Certainly the ground reality has changed sharply since the so-called peace accord gave Maoists almost a third of the seats in the interim Parliament. Despite such a precipitous political tilt in their favour, Comrade Prachanda has not felt confident of surrendering arms as per the accord, and wishes to join the interim Cabinet without adhering to his part of the bargain. His people are now claiming that they see no need to fulfil any precondition set by the Government, and are threatening to ‘delay’ the June election unless immediately accommodated in the interim Cabinet. Government sources are dismayed at the delay in arms surrender and legitimately fear that arms may play a role in the forthcoming election.

During a visit to New Delhi last week, Nepali Congress leader Sujata Koirala complained that the Maoists have gone “out of control” and are an obstacle to her country’s transition to a full-fledged democracy. She claimed the Maoists have resiled from all promises, have not surrendered all arms or returned lands seized previously. Indeed, she said, the Maoist cadre is still threatening the people, the police and even foreign diplomats. Even former Prime Minister Sher Bahadur Deuba has charged the Maoists of breaking their promise to return seized public property; he fears this could affect the Constituent Assembly election (The Rising Nepal, February 8, 2007).

Although Ms Koirala was too polite to express dissatisfaction with the UN’s handling of the arms issue, in the light of India’s sad experience with the UN mission on the Indo-Pak border, I can only surmise that a devious international game is afoot to give an unrepresentative bunch of thugs the control of this strategically vital nation. Not surprisingly, Ms Koirala, who is known for her political candour, has asked India to perceive the Nepal situation as a “fire in the neighbourhood”, and take appropriate action before it engulfs us in turn. Given the grim situation in States battling Naxalite violence, not to mention ISI presence in both countries, the warning is apt. It remains to be seen if it has been well received; it is not clear which UPA leaders she succeeded in meeting during her stay.

Ms Koirala revealed that Nepal’s greatest problem is law and order and that Home Minister KP Sitaula is widely perceived as being ‘too friendly’ with the Maoists, and hence unable to act decisively against them. She took public opinion by surprise when she defied her father, Prime Minister Girija Prasad Koirala, and openly demanded Mr Sitaula’s resignation on the issue of the Terai violence. It appears that many political parties in Kathmandu are waking up to the reality of the ‘coup’ that has gifted the Maoists a major share of the interim Parliament, without any proven ability to truly represent the people. With arms surrender inadequate, and suspicions about UN collusion with the Christian leadership of the Maoists rampant (even if unstated), the constituents of the Seven-Party Alliance have found a heaven-sent escape route in the Terai flare-up.

The trouble in Terai broke out unexpectedly on January 19 this year, when the escort of Maoist leader Ram Karki shot at and killed Madhesi Janaadhikar Forum activist Ramesh Kumar Mahato in Lahan district. The situation deteriorated when the Maoists seized the dead body and forced the family of the deceased to immediately cremate the body. The resultant public anger boiled for three weeks, taking at least 38 lives and leaving several injured in police action, before a truce was called.

This brought international spotlight on the Terai’s gross under-representation and forced Prachanda to agree to a draft Bill to amend the interim Constitution. Once approved by the interim Parliament, Articles 134 and 154 of the interim Constitution will be amended to provide a federal state structure and new constituencies in the Terai, as also additional seats for proportional representation according to the percentage of population growth. It is thus envisaged that 20 constituencies will be added in Terai and four in the hill regions. An additional 20 seats will be increased for proportional representation.

According to The Kathmandu Post, this means that the 20 southern districts, which comprise 48.4 per cent of the population, will receive 49 per cent seats in the Constituent Assembly. The remaining 51 per cent seats will be divided among the 55 hilly and Himalayan districts, which constitute 51.6 per cent of the population. This appears to be an equitable distribution, and it is to be hoped that the aged and sick Prime Minister will be able to execute the delimitation exercise properly.

Political empowerment of the aggrieved and anti-Maoist Madhesis, however, is unlikely to go down well with Prachanda, who is again busy shifting the goalposts, violating the spirit and substance of the November 21, 2006, accord. Indeed, less than a month after declaring peace, Maoist goons had resorted to large-scale violence and intimation in Kathmandu on December 18, 2006, to force the Government to cancel the appointment of Ambassadors to 14 countries, including India. Now they are trying to muscle their way into the interim Cabinet without surrendering arms.

Given their unreliable nature, the original seven parties of the interim Government would do well to seize the political initiative, rather than let Prachanda dictate the national agenda. The SPA should dissociate from the plan to abolish the monarchy, and emphasise a truly federal polity. It should support retention of Hindu supremacy in the Himalayan kingdom, with safeguards against fraudulent conversions currently being pushed among border and marginal communities; already a major portion of Nepal’s Buddhist community has been converted to Christianity in the past few years. The SPA should also call upon the Nepal Army to ensure free and fair elections in June, as it is virtually certain that the UN will fail to control the murderous People’s Liberation Army.

Participants of an interaction in New York have urged all Hindus across the globe to work to defend Nepal as a Hindu nation.

Speaking at the interaction organized by Sanatan Darma, Sanskrit and Nepali Center at Shree Satya Naraian Temple, New York City Hindus from various parts of the United States, Canada, India, Bangladesh, United Kingdom, Bhutan, Shri Lanka, Trinidad, Guyana and Nepal expressed solidarity for Nepali Hindus to make Nepal a Hindu nation.

The parliament reinstated following the success of the April movement has declared Nepal as a secular country. Hindu activists are protesting against the parliament’s decision and demanding to make Nepal a Hindu country.

A press release issued by the organiser said, scholars from the Indian American community Arish Sahani and Shree Gaurang G. Vaishnav, General Secretary of Vishwa Hindu Parishad (World Hindu Council of America) Raju Bhatija and Vijay Sigdel, a political activist from Nepal presented their views in favour of making Nepal a Hindu state.

Speaking at the programme, Vaishnav said that all Hindus must be united and rise up to defeat the foreign and internal enemies who wish to divide the Hindus.

Bishal Bikram Shah, a Nepali scholar currently living in New York city condemned the violence and pelting of stones during the visit of His Majesty King Gyanendra to offer prayers to Lord Pashupatinath on the auspicious occasion of Maha Shivaratri.

He demanded that the miscreants, hooligans and criminal elements be arrested and punished.

Ascent of the anti-Hindus

Barely a month after his visit to New Delhi for support in rebuilding his Maoist-ravaged country, Nepal’s appointed interim Prime Minister GP Koirala has delivered his unhappy nation into the hands of its worst tormentor and retired to a hospital bed. Whispers from Kathmandu suggest that Prachanda, would-be President-King of the former Hindu kingdom, is a Christian. There is little reason to doubt these voices, as similar murmurings about LTTE supremo V Prabhakaran proved correct, and Sri Lanka’s Tamil Hindus admit that the organisation does not serve their political, economic or cultural interests in any way. Its objective is to provide its covert Western backers a foothold in the region.

With Prachanda’s ascent in India’s hinterland, the West has executed a far greater coup than the secession of East Timor from Indonesia. If South Block is unmoved, it is only because an Italian Roman Catholic has successfully subverted the national ethos and subjugated the country to American geo-strategic interests. It is truly shocking that New Delhi has refused to react to the fact that an aged politician, appointed for an interim period in the wake of a popular agitation, has inaugurated the most audacious changes in Nepal’s polity without any mandate from the Nepali people.

Instead of supporting Hindu Nepal, its civilisational ally, the Sonia Gandhi-dominated UPA regime is shamelessly working to accomplish the West-sponsored Maoist agenda. The centuries-old Hindu character of the country has been tossed aside, and the monarchy and the Royal Nepal Army which symbolise the nation discredited. Though the supposedly popular uprising (the cognoscenti say the streets were crammed with paid lumpens) aimed at electing a government and restoring the democratic process, it now transpires that Nepal is going to be subverted through a new constituent assembly, which was never on the people’s agenda.

It is true that King Gyanendra is not respected like his late brother. Yet realisation is beginning to dawn in some quarters that the political parties that constituted Nepal’s fractious democratic process have been rendered completely irrelevant by plans for a new constituent assembly. This is because the Seven Party Alliance (SPA) regime is being blackmailed by Maoist threats of renewed violence and bloodshed, and this threat may impact upon the results whenever elections are held. Prachanda, dreaming of the Nepali version of the Imperial Presidency, is advocating United Nations supervision of the polls, when everyone knows that the UN is an agent of the West, especially under Kofi Annan.

America is seeking to enthrone Christian stooges wherever it has strategic interests. Ideology is a ruse, mere washable distemper. This will become apparent when the new constitution officially abolishes the Hindu nature of the State and espouses minority rights, despite the fact that there were no minorities in Nepal until the West and the ISI jointly evangelised the region as part of a policy of containing India. Nepal’s new constitution will offer freedom of religion (sic), a euphemism for the freedom to convert Nepalis to Christianity.

Eradication of the Hindu character of Nepal is the sole raison d’etre for the present de facto regime change, and its instigators are the American-led West, operating through anti-Hindu communist groups in both India and Nepal. Notwithstanding their pretended anti-imperialist rhetoric, there should be no misunderstanding that Communists serve any power other than the West. Russia is officially non-Communist and China is Communist in name only. Left radicals enjoy untold luxury and wealth solely in America, populating its elite universities and NGOs. They are Christian America’s natural allies in hurting the native civilisational ethos in non-Christian countries targetted by the West, and are doing a thorough job in Nepal.

The great Pashupatinath mandir, as critical to Nepal’s cultural traditions as India’s Vishwanath temple at Varanasi, has been singled out for secular assault. It has been asked to submit its accounts for scrutiny by unelected unbelievers. This is an outrage, an act of iconoclasm as grave as the destruction of the Bamiyan Buddhas by the American-trained Taliban. If Nepalis fail to respond to this insult with the ferocity it deserves, they should be prepared to witness the cross replacing the shikar over the sanctum sanctorum.

Prachanda has made several revealing statements. Last year, he told Time magazine that when he launched the so-called people’s war in 1996, he did not have a single modern weapon or any trained armed cadres (April 18, 2005). Anybody who has observed the insurgency in India’s North-East would readily identify the religious affiliations of the international sponsors of such ‘people’s movements.’

More importantly, Prachanda is determined to keep his arms and armed cadres intact even after elections to the proposed constituent assembly are over. This is obviously to secure an advantage (sic) which the elections might deny him. He could then emulate Lenin and enact a Winter Palace-style of coup against the country’s effete politicians, who have so far behaved with sheep-like stupidity. This has emboldened him to suggest that his Maoist insurgents could join and take over the Royal Nepal Army (RNA)!

Ms Sonia Gandhi’s supremacy having ensured an unfriendly India, it is not known what kind of cards the King and Army still retain to defeat this virtual colonisation of Nepal. But it is almost certain that they cannot beat back this challenge alone. Nepal’s notoriously divisive political parties have not shown any awareness of the nature of the threat facing the nation, so it is too early to say if they can unite with the King and Army for a larger purpose. If Prachanda formally seizes all power in Nepal, there is little doubt that America will seek bases on Nepali soil, in order to ‘contain’ China. This does not augur well for India. Yet we must prepare for this eventuality, as there is no other reason to plant a Christian in Kathmandu.

The 21st century seems set to witness a major geographical realignment with old national boundaries being merged into larger conglomerates. America already calls the shots in Pakistan and through it, in Bangladesh. It has bases in Afghanistan, and Tibetan leader, the Dalai Lama, has been cultivated and controlled through a Hollywood star. Christian supremos have been put in place in India and Nepal, while Christian protégés are being promoted in Sri Lanka and Myanmar. That gives you a new political entity already christened by the US State Department – South Asia. Not a nice thought; not one that can be readily dismissed either.

Two killed, dozens injured in restive Lahan

Two persons were killed and dozens of others wounded in Lahan, Siraha district, when police opened fire as angry protesters tried to ‘attack’ a police post Monday afternoon.

One Pramod Sada, a 15-year old school student of Lahan Municipality, and another Bijay Kumar Sahani of the same municipality were killed when police opened fire on the crowd, reports said. Over three dozen others were injured in the police action.

Reports quoted police officials as saying they had to open fire in self defence as the protesting crowd led by Madhesi People’s Rights Forum tried to bring down the Ilakha Police Post. Police had fired several rounds of live ammunition and teargas shells during the incident.

12-hour long curfew has been imposed from 4:00 in the afternoon in the town in the wake of ensuing violence. Lahan remained tense from early morning as the MPRF continued its protests against the killing on Friday of a student, reportedly by the bullet fired by a Maoist cadre, during a rally.

11 hurt in Nepal Maoists attacks

KATHMANDU: Eleven people including six policemen were hurt in separate incidents in Nepal involving the Maoists just days after the former rebels joined the political mainstream by entering parliament, officials said on Sunday.

The policemen were wounded when 200 Maoists, carrying batons and stones, attacked a police post on Saturday, at Patabhar, 350 km southwest of the capital, Kathmandu. “Three of the wounded policemen have been rushed to a nearby hospital with head injuries,” district official Shiva Nepal said.

“The Maoists ransacked the post, threw out belongings and utensils of the policemen before leaving the area,” he added. Maoist leaders were not immediately available for comment.

Nearly 2,000 police posts, closed during the 10-year anti-monarchy Maoist revolt, are being reopened across Nepal after rebels and the government signed a peace deal in November. reuters

Royal Nepalese Army On Frequency Modulation

During press briefing, RNA spokesperson revealed that RNA will operate six FM radio stations across the country to counter Maoist propaganda. Earlier Minister for information and communications had said that the government has issued licenses to Royal Nepalese Army (RNA) to run FM radios. He has also assured to the visiting International Advocacy Mission for Press Freedom in Nepal that “it would not limit the independent freedom of expression” as “it is not unconstitutional and undemocratic for the army to run FM stations”.

There are many countries in the world including UN Peace Keeping Missions where army has been running not only FM but also AM and TV stations to support mission accomplishment. There are many instances where military contingents of western rich countries deployed in UN peacekeeping missions run their own FM stations. Nowadays, UN Peace Keeping Mission HQs run its own radio stations in host country territory in international and as well as local languages. The US Army use strategic, operational and tactical radio and television broadcast transmitters to conduct psychological campaigns. These involve from long range AM radio, TV to short range FM radio broadcasting stations. The US and UK Army run radio stations in all theatre of wars. British Gurkha in Hong Kong had its own radio transmission station. Therefore it is not a new introduction in Nepal.

Nepal is embroiled at conflict. At abnormal situation no one should expect normal state It is a known fact for everyone that Nepal has been fighting a war against violent Maoist insurgency/terrorism since 1996. The Maoists run their own mobile FM radio stations to spread communist propaganda and psychological terror. In Nepal most private print media freely publish material put out by the Maoists including the interviews, statements, articles and bandh programmes called by the Maoists. Because of this, people change their attitude and behaviour in favour of the Maoists. Bandh called by the Maoists become successful primarily due to some media publicise them without giving serious thoughts about its impact on national life. The Maoists conduct mass indoctrinations through organising mass meetings in the countryside and use private electronic and print media to indoctrinate the urban educated middle class. To counter all these government was lacking an effective media campaign that could effectively neutralize Maoist propaganda and remove sense of psychological fear among the populace.

RNA’s plan to run FM stations with the goal of countering Maoist propaganda as part of integrated response plan against the Maoists sounds very natural and encouraging. The necessity was seemingly corroborated by the fact that existing private FM stations did almost nothing to counter baseless propaganda and psychological terror spread by the Maoists. Rather in many occasions they were successfully used by the Maoists. Not only at countryside but also in cities including the capital, the Maoists used its FM stations to spread communist propaganda with the theme of demoralizing the security forces and the people to fulfill their objective.

However, just by running the FM station in itself is not going to be an achievement. It depends on how effectively it could jam Maoist FM broadcasts, and counter the Maoist propaganda by putting out its own effective psychological campaign products.

Taking lessons from other countries, it can be recommended that Army FM radio stations operating in conflict/combat zones should indeed aim to function to effectively jam insurgent mobile and static FM station broadcasts, counter insurgent propaganda & terror campaigns, raise morale of its men and destroy insurgent’s will to fight, inform achievements of the government and security forces to the people & broadcast recreational materials preferably on local languages for the benefit of local communities.

Some quarters in Nepal maintain the view that Army should be sent to fight a war alone only with guns and bullets by restricting all other means that would require help win the war. All would agree that integrated approach is the only best solution for countering an insurgency. Such integrated response plan to counter insurgency should indeed encompass media campaign, political campaign, social-economic development campaign, military campaign and so on. The fact remain is that counter insurgency campaign is not a stand alone military campaign rather military is only one of the instruments of government. Government run radio and televisions could also be utilised to counter the propaganda spread by the Maoists and other internal and external ill elements.

Last year when government banned FM radios to broadcast news then they challenged the government to rather stop Maoist FM stations from broadcasting news. Now RNA got that job. Again some private FM stations have shown their anger and dissatisfactions over the decision on the ground that RNA FM radio would curtail their business profit. But question is how a non-profit making FM radio station having entirely different objectives could harm profit oriented private FM stations? By creating secured environment through gradual victory over insurgency would indeed help private enterprises to grow.

Maoists seize godown; obstruct all development projects in Khotang

Giving continuity to their act of capturing public properties, the Maoist rebels have captured six ropanis of land along with the building and godown belonging to Agriculture Inputs Company (AIC) at Phidim of Panchthar district since Friday.

According to newspaper reports, the Maoists captured the building and godown to establish a camp for their peoples’ army.

The building belonging to AIC had been leased out after the office shifted to Ilam on September 17.

The Maoists have set up tents on building premises. Newspaper reports quoted Maoist district in-charge Raman as saying that the AIC building and land was captured because it was quite appropriate for Maoist peoples’ militia to stay until the ongoing peace talks reached decisive turn.

Maoists captured public properties including the office building of Nepal Television regional transmission centre Kohalpur of Banke to establish camps to their militants. However the Maoist leadership remained tight lipped in such issues, which is clear violation of the 25-point code of conduct signed by the government and the rebels and other accords reached with the ruling seven party alliance.

In another report from Khotang, all the developmental projects in the district have come to halt following Maoist obstruction.

According to The Kathmandu Post daily, the projects stopped their activities after the rebels recently wrote them saying, “development without political settlement was meaningless”.

According to District Development Committee, its total budget of 130 million rupees for the development works has been frozen following the Maoist threat not to carry out any development work.

The construction of Diktel-Khotang bazzar and Lamidanda-Aishelkukharka road projects, funded by DFID were also halted due to the same reason. nepalnews.com pb Nov 05 06

Three hurt in blasts in Bara

Three people including a seven years old girl were injured in two blasts in Brahmahapuri area of Bara district Saturday evening.

The blasts occurred on the road, almost simultaneously, at around 4:45 p.m., injuring two women and a seven years old girl who were walking on the road, the state-run Radio Nepal said quoting police officials.

The area is close to Bara district headquarters, Kalaiya. A similar blast had taken place near Brahmahapuri early Saturday morning but no casualties were reported in the incident.

It is not known how the blasts occurred. The local Maoist leadership has expressed ignorance over the blasts but local residents said that hundreds of Maoist militias had been staying in the nearby villages over the last few days and they might have left behind the explosives.

Maoists not abiding by pacts: Sitaula

Home Minister Krishna Prasad Sitaula, who is also the chief government negotiator has alleged that the Maoists are not abiding by the ceasefire code of conduct and various agreements reached between the ruling seven party alliance and the Maoists.

Talking to journalists in Birtamod of Jhapa on Thursday, Sitaula said the government is adhering by all pacts.

“Although, the Maoist leadership has been frequently expressing their commitments to abide by the agreements, there have been ample instances of violations at the local level,” Sitaula added.

He also called the rebels to seriously abide by the agreements reached between the ruling seven party alliance and the Maoists.

Students set ablaze central department of Education

Students of the Education Department of the Tribhuvan University set ablaze the central department of Education Thursday alleging that the recent results of Masters Level first year were not fair.

They charged that only a few students passed in the exam and those who had passed the exams also scored minimum marks.

Students have been demanding re-checking of examination papers alleging that there was partiality in the checking.

There was huge loss in the department due to the fire with the actual loss is yet to be calculated.

Police had to use force to disperse the students as they tried to block the fire brigade from putting off the fire.

Angry sportsmen gherao media office for ‘mistaken’ news report

A group of angry sportsmen gheraoed the office of the Kantipur Publications at Teenkune, Kathmandu, this afternoon to protest a ‘mistaken’ news report on Kantipur Television over the killing of karate player Rakesh Gurung in police firing last night.

Over 200 protesters demonstrated in front of Kantipur Publications and barred the staff from coming outside the main gate of the office. A journalist with Kantipur daily told Nepalnews that the protesters pelted stones at the office of the Kantipur Publications.

The protesters said that the KTV news report that Gurung was shot dead while trying to rob a policeman at Gyaneshwor was mistaken. Following the protest, the KTV said it had corrected the report and apologized for the mistaken report.

Assistant Sub-Inspector of Police, Man Bahadur Adhikari, who is the bodyguard of CPN (UML) general secretary Madhav Kumar Nepal, allegedly opened fire at Gurung. Badly injured Gurung succumbed to injuries at the TU Teaching Hospital, Maharajgunj.

The protest in front of Kantipur Publications was going on until 6:30 p.m. There were no reports of violence, however.

Irate sportsmen had carried out protests against the killing around the capital city from the morning, brining the vehicular traffic to a halt at many places.

Maoists continue abductions, intimidation, extortions

KATHMANDU, Aug 2 – Maoists continue to violate the understandings and agreements reached with the Seven-Party Alliance (SPA).

On Tuesday they abducted a CPN-UML member and held him captive for more than four hours in Kathmandu.

Four Maoists abducted Prakash Maharjan, 46, of Kirtipur Municipality 3, yesterday morning from his house on the charge of tearing a Maoist pamphlet stuck at the door of his private room, Sunday. The pamphlet was about the 4th national conference of All Nepal Carpet Workers’ Union (ANCWU) scheduled for 6-9 September.

“At around 6 o’clock this morning, four people arrived and took me forcibly from my house saying that they were sent by senior leaders,” said Maharjan who runs a carpet factory and employs 25 people.

They warned and scolded his family members too. They took him inside a carpet factory in Gongobu where there were about 15 people. They scolded him for tearing up their pamphlet and said that if it were not a “normal period”, they would punish him severely.

“Later, they released me handing over six pamphlets of Prachanda to stick at my house and said that as punishment I must provide at least two rooms for them whenever they come,” he said showing a roll of pamphlets. The Maoists offered him Rs 50 as bus fare saying they would recover it from him later.

In the afternoon, another group reached Maharjan’s house and stuck a notice where they have announced public action against carpet entrepreneurs who have been acting against the welfare of carpet workers.

Carpet entrepreneurs of Kirtipur said Maoists have been threatening them with action if they fail to fulfill demands related to carpet workers. The Maoists have also asked for donations and to send all employees compulsorily to attend the national conference of ANCWU.

Similarly, a group of Maoist activists have been intimidating people in the outskirts of Kathmandu Valley and extorting money from them since a week.

Four girls and 21 boys, all Maoist cadres, have been roaming around Machhenarayan VDC as well as Batkeyapati, Bistagaun, Chhap and Taudaha of Kirtipur Municipality.

“They arrived on Friday evening, took shelter and had dinner at different houses in Narayansthan forcibly,” a local of Machhenarayan VDC said. On Saturday morning, they organized corner meetings and distributed memberships of the party and student organization to the locals. They also asked for voluntary donation.

Locals said they feel terrorized.

Meanwhile, another local of Chalnakhel, an area along the highway to Godavari, said 19 Maoists reached there and visited a primary school. Students were frightened. They said they were roaming around villages to interact with the public and were seeking support for the “October Revolution” in case the ongoing peace talks failed to reach a logical end, locals said.

A few days ago, a similar group of Maoists reached Siuchatar Village of Kathmandu and intimidated and extorted money, villagers said.

Maoist atrocities unabated, double ‘road tax’ in Sarlahi

BIRATNAGAR, July 31 – Maoists on Sunday abducted a CPN-UML cadre in Morang while they have kept an elderly in their labor camp. The rebels also doubled the “road tax” that they have been illegally collecting from vehicles plying along the East-West highway in Sarlahi, since last week.

The rebels, just two days after they extended ceasefire by another three months on Friday, abducted Jageshwor Mandal, member of UML village committee, from his house at Aamgachhi-9 in Morang, on Sunday afternoon. Denouncing the abduction, CPN-UML Morang, urged the Maoists to release him promptly.

Similarly, Maoists abducted Rajendra Karki, resident of Hoklabari-2 in Morang, from Ghoghapul in Biratnagar, Sunday evening. According to his family, Karki was on his way to Bolbam pilgrimage. “The Maoists didn’t leave him even as we requested them to let him make the pilgrimage and promised to come to them after it,” said one of the villagers who was with him during the time of abduction.

Meanwhile, reports from Itahari saying, Maoists seized Ram Bahadur Tamang of Khanar-7 in Sunsari, and kept him in their “labor detention camp” for the last nine days.

Tamang is made to work in the field of a Maoist cadre Manohar Chaudhary for eight hours a day, as punishment for being involved in a “cultural crime” (illicit affair).

“I have been exploited here,” said Tamang. “I’m ready to undergo any punishment as per the laws if my crime is proved by a court.”

Meanwhile in Sarlahi, Maoists from Sunday doubled the “road tax” which they had imposed for “highway security patrol”.

The rebels had been charging 10 rupees per vehicle a week ago, as looting of vehicles along the highway was continuing the past few weeks. The Maoists also claimed to have begun such highway patrols to provide security to vehicles as security forces failed to do so.

“We have taken the decision after a week’s trial,” said vice-commander of second division of the Maoists, Pramod. “We increased the tax as we have to deploy over 50 militias for the purpose.”

The rebels have also put up a check post in Laxminiya since Sunday while they had already established one at Ranigunj Chowk.

India: Charm that Hurts Nepal

For me the hardest thing to digest has been India’s role in all this – heretics such as S.D. Muni and Yechuri all make trips and consult their henchmen (SPA and Maoist), in India – we all seem to know about this but act nonchalant. Nepal is becoming a remote controlled nation.

I read Kantipur sometimes, I abhor it, and find news as if doctored by the South block. For me they represent India rather than a credible newspaper. A friend who works in a Himalayan Bank innocently squealed that Kantipur Publishing House deposited Rs. 64 crore in four banks, one being his.

More or less, most people agree that the way things are, it only means a civil war. Even if Maoists stay on the backs of SPa take over, resistance will crop up, to defeat unilateralism and draconian laws and policy that the Maoists espouse, with definite curtailing of speech, freedom and individual rights. The endgame for them and to COMPOSA is to make a Nepal a model communist state. Now, the quandary is – knowing all this India is hell bent on supporting the Maoists and SPA. What gives? The logic can be only one thing – Nepal is not a country but a puppet regime under and by South Block. It shows that for India, anything is ok and can be handled except the Monarchy. In their eyes, a true Nepal is one without the King, and the rest is within their realm by hook or crook.

It is quite naiive to chit chat only about the SPA and Maoists because at the end of the day – it is India who is running them both. I do not suspect this, I take this to be the truth. Nor is it a question of India bashing or being anti-India! But somewhere in retrospect – I see a well defined map by India with total disregard for the people of Nepal. Not a good move even by the standard they have set for themselves with all the neighboring countries.

If there is a concerted effort by the powers-that-be then I see Maoists making a hasty retreat with compulsion to join the main stream without arms. The effort must be on making a level playing field for everyone, not just big parties or a renegade party but for all without the chance of affording parties (big, renegades) to hijack the better interest of the nation on behest of a Foreign country.

I see less chance of better judgment prevailing in India in regards to Nepal and the necessity of Monarchy in Nepal. So it is upon us to set the stage whereby in a gradual process we create a platform that propagates nation building from within, practically putting our house in order that can rebuff unwarranted and unnecessary foreign intrusions. To achieve this, I assume we must share the burden in all aspects to formulate a charter that is all-encompassing in terms of ethnicity, social, political and economic aspects. The task is uphill but the time to start is now before it is too late.

Maoist supremo is now on the threshold of refolding and re-writing Nepal’s history

If there is anything that the present government ministers have succeeded in doing is creating chaos and confusion among the people. One is just amazed to look at the mess that they have managed to create in such a short span of time. By giving a red carpet welcome to the Maoists in the capital city, which according to Prachanda himself his guerrillas could have otherwise never managed to overcome by military means, the seven party alliance is dismantling every institution, legal edifice and constitutional procedures that has taken over a decade to build and that are so essential for any democratic, modern nation of the 21 st century.

There has been a commission formed to probe intro atrocities committed during the people’s movement in which altogether 21 people died while the perpetrators of a violent insurrection in which thirteen thousand have lost their lives were welcomed and cheered into the Prime Minister’s official residence. They have declared that the lower house is sovereign and have ordered all chiefs of constitutional bodies to come and take oath before it not realizing that the same supremacy of the parliament could be used by a future dictator to transform himself from a democratically elected Prime Minister to a modern day Hitler. If the parliament is regarded as “sovereign” then a Prime Minister who is selected from a political party that secures the most number of seats can easily declare himself sovereign just like Adolf Hitler. Justices of the Supreme Court publicly declared that they will not go to the House for oath-taking and shamelessly the House proclamation was “revised” to go well with the warning given by the Justices. They have formed a small committee to draft an interim constitution but haven’t given the ToR nor the appointment letters to its members. Now, the committee is being expanded to induct a few women members. Questions are being asked by the M.Ps themselves on how can two odd coordinators of the peace talks have the authority to announce the formation of a committee to draft an interim constitution of the country. One of the members Shambhu Thapa has publicly said that by not inducting a royal palace nominee in the committee, we have already opened the possibility of one of the three sides of the conflict to remain infuriated for a long time to come. Another member is a Maoist cadre while Sindhu Nath Pyakurel is supposed to be very close to the Maoist leadership. Purposefully, we have already dismantled the 1990 Constitution hailed by many as being one of the best in the South Asian region for its liberal provisions on freedom of citizens and fundamental rights, while blindly entering into another without even knowing whether we can safeguard the fundamental rights enshrined by the 1990 Constitution itself.

Without giving up arms, the Maoists are set to join the interim government and some of the ministers are happy that the Maoists are finally going to join the mainstream. But the last time a political party with arms joined the government was the Fascist Party of Benito Mussoloni in Italy. Only in Syria, North Korea, Cuba and Saddam Hussein’s Iraq the ruling parties also have their own private armies. If the Maoists join the interim government without giving up arms, they will practically be controlling two armies at the same time-the Nepal Army and their own People’s Liberation Army. Thanks to SPA, we will soon get a glorious opportunity to join the community of nations under the ‘axis of evil’.

The Nepal Army was infuriated by the reckless comments by the Maoist boss and naturally it had to speak aloud on its balconey only to be told by the Minister of Agriculture that it was not the business of the Army to comment on political matters. But what authority did the Minister of Agriculture himself have to comment on the remarks of the national army which essentially comes under the ministry of defense? One of the two Deputy Prime Ministers thought that the army was compelled to give a statement as none from the government said anything on this regard while the other Deputy Prime Minister thinks that the army’s conduct wasn’t proper. General Secretary of the CPN (UML) sensed “nothing wrong” in it while the Home Minister was not happy. Finally, the Maoist boss himself “corrected” his words in an interview with the state-run Nepal Television.

Amidst this confusion, U.S. Ambassador to Nepal, James F. Moriarty, said that his country would not recognize a government in Nepal if it inducts Maoists without them giving up arms. Indian Marxist leader, Sitaram Yechury, on his occasional visit to Kathmandu bounced back at the American envoy saying that Moriarty was clearly crossing diplomatic norms. But, what diplomatic norm is Mr. Yechury himself following by coming to Kathmandu repeatedly and pressurizing the government to yield more to the Maoists? If an envoy of the Indian government in the form of a leader of the CPI (M) has to land in Kathmandu every now and then, what is the use of the Indian Embassy in Kathmandu which is regarded as one of the biggest of Embassies in the world? Besides, Prime Minister Koirala has just been to Delhi and had substantive talks with his counterpart including other Indian leaders. Yechury’s recurrent visits and his overtures to coerce the Nepal government to induct the Maoists with arms into the government or even to have an interim government headed by the Maoists is in fact a gross interference in the internal affairs of a sovereign country.

Interestingly, it is said that Yechury’s party was actually on the side of China during the Indo-China war of 1962. After 45 years, the two blocks of the leftist parties of India are experimenting another variety of armed conflict that will definitely have long-lasting effects on the national security interests of their own country. Quite a few articles are being written by Indian authors that suggest that India could well annex Nepal as it did with Sikkim in the eventuality of a Maoist takeover of Nepal. They feel that “Nepalese in the broadest sense would welcome India’s invasion of Nepal as the Maoists are hated and disliked for their atrocities committed for over a decade”.

But the Maoist leadership is smart enough to recognize which way the wind is blowing and whom to betray when. Just after a few days following Prachanda’s statement inside the Prime Minister’s residence in which he criticized the Nepal Army for betraying the proud Nepali nation ever since the Sugauli Treaty of 1816; a senior leader in the LTTE Mr Balasingham, one of the oldest confidants of LTTE supremo Vellupillai Prabhakaran admitted the LTTE’s role in the killing of the late Prime Minister Rajiv Gandhi. It is indeed an irony that the LTTE which had received training, resources, material and moral support from India under Indira Gandhi and Rajiv Gandhi ultimately accepted the killing of Rajiv Gandhi. This same destiny is in some way repeating in Nepali politics by Prachanda publicly mentioning about the Treaty of Sugauli in which Nepal lost much of its territory to British India. Prachanda has thus made himself the one and the only politician in contemporary Nepal to voice his resentment against this treaty which was inked in haste after Nepali Army’s defeat with the then British Empire. Over 5 million Nepalese speaking diaspora continue to live in various parts of India but still consider themselves as being part of the Great Nepal which stretched once upon a time from Tista to Kangra.

Thanks to the facilitation by New Delhi primarily by the two Indian leftist parties to bring the Maoists into the mainstream, New Delhi has repeated its LTTE fiasco and the Maoist supremo is now on the threshold of refolding and re-writing that part of Nepal’s history which is regarded as disgraceful and shameful by every nationalist Nepali. Prachanda could well be a leader of not only the Nepalis living inside Nepal but also those Nepali brothers and sisters that have been living outside. None after King Mahendra and Madan Bhandari have been able to enthrall the Nepalis on the self-respect that we were never colonized. If he wants to rectify his image tarnished by the killings of innocent Nepalis since 1996, Prachanda can and must use the nationalism card once again and get inducted in an interim government. The days of proud Nepali nationalism are visible here.

Dacoits kill one, injure two in Nepalgunj; nine robbery suspects nabbed in capital

KATHMANDU, July 26 – Armed dacoits killed a person and injured two others in Nepalgunj, Banke district, Tuesday night.

According to our correspondent, a gang of dacoits armed with guns, tried to loot one Ram Niwas Maurya’s house at Magantanpura of Nepalgunj.

The dacoits shot Maurya dead when he defied them. The dacoits beat and injured two other persons, including a woman.

The injured are undergoing treatment at a local hospital.

Meanwhile, police on Tuesday night nabbed nine persons suspected to be involved in the recent robbery cases in the capital, reported our correspondent Jitendra Sah.

Six robbery suspects were arrested from a taxi (registration no Ba 1 Ja 5337) from Chapali-4, Bishnu Budhanilkantha VDC. They were carrying pistols and magazines and were arrested before they could execute a looting plan in the area, police said.

Similarly, three persons, armed with knives and swords, were arrested from Nardevi.

In another case of looting, robbers took away about 25 tolas of gold, two mobile sets and Rs 2000 cash from one Narendra Raj Joshi’s house at Nagabahal, Lalitpur, Tuesday night. Joshi is an employee of the Nepal Bank Ltd, Main Branch Office, New Road.

The robbers had guised themselves as security personnel to execute the looting.

Yet another mugging took place in Sunsari’s Sri Lanka Tappu of Prakshpur VDC on Tuesday night. A group of 20 people armed with guns looted Arjun and Bhim Chandrabanshi’s house. They looted two tolas of gold, 15 tolas of silver and Rs 75,000 cash at gunpoint.

According to Yudhisthir Chandrabanshi, the robbers kidnapped Bhim Chandrabanshi, Laxman Chandrabanshi and Baiju Yadav while they tried to retaliate them. The whereabouts of these three is still unknown.

Police arrest nearly two-dozen disabled people

Police arrested nearly two dozen physically challenged people from the protest programme organized by the Federation of Disabled People in front of Singha Durbar, the main administrative hub of the country demanding their representation in the Interim Constitution Drafting Committee.Police detained 14 physically challenged people at Mahendra Police Club and the rest at the Ward Police Office Tinkune.

Physically challenged people have been continuing their protests saying that the democratic government had neglected their demands. One of their demands is reservation for disabled people in all sectors.

They are scheduled to join the protest organized by Citizens Movement for Peace and Democracy at 4 p.m. in the afternoon.

Issuing a press statement on Tuesday, the National Human Rights Commission said that it is closely monitoring the demonstration.

The Commission has also urged the protestors to conduct their protest programmes peacefully respecting rights of others while enjoying their own constitutional rights.

Dozens of former Kamaiyas arrested

Police have taken into custody nearly 100 former Kamaiyas (bonded labourers) as they were trying to organise a protest program in front of Singha Durbar demanding for land and employment opportunities for them.

The government had abolished the practice of bonded laborers six years ago on July 18. Out of over 35,000 bonded labourers from ethnic Tharu communities in four districts of western Nepal, 19,000 former Kamaiyas are yet to get a piece of land as promised by the government, according to reports.

Kathmandu , 18 July: BBC Nepal has raised some questions regarding its credibility as it recently broadcasted false news regarding participation of the people on the King’s birthday, writes Janasatta weekly on its editorial.

Although tens of thousands people went to the Narayanhiti palace on 7 July to wish the King his sixtieth birthday, the BBC correspondent of Nepal quoted false news stating that only about two thousand royalists attended the King’s birthday.

Despite the fact that the government cut off the tradition of declaring public holiday on King’s birthday, tens of thousands people stood in queue from eleven O’clock in the morning to late five O’clock in the afternoon to wish the King his birthday but the BBC correspondent of Nepal fabricated the whole news that raised some serious questions regarding the credibility and accuracy of such a reputed institution like BBC.

BBC should initiate an investigation on the intention of its Kathmandu representative who despatched such a false report.

Maoists to continue extortions until aid flow stops

Butwal, 12 July: CPN (Maoist) central member Suresh Ale Magar said aid flow to government from donors stops, his party will continue to collect donations, Gorkhapatra reports.

When the government is feeding its army with donations from India, USA, China and others, why cant we ask for donations from the people to feed our army, he asked.

He said voluntary donation collections will continue until a government of seven parties and Maoists is formed.

Dispute forces closure of 450 industries

Kathmandu, 13 July: A dispute between rival trade unions, including one affiliated with Maoists, Thursday forced the closure of 450 industries in Bara and Parsa districts in south central Nepal.

Other industries closed down after rival unions protested the Maoist forced closure on an industry in Simara continuing hiring of labourers on contract.

Dozen still in Maoist captivity

GULARIYA, July 11 – Over a dozen individuals, including two Nepali Army soldiers abducted from Bardia in the last three years are still in Maoist captivity. This fact surfaced only days after the media reported Maoist spokesperson Krishna Bahadur Mahara as saying that his party does not have any captives.According to Informal Sector Service Center (INSEC), Nepali Army soldier Krishna Prasad Adhikari was abducted by Maoists on July 18, 2004 in the course of a confrontation. Adhikari was posted at Karnali Chisapani bridge on security duty. Maoists have still not released him.

Maoists also abducted Adhikari’s younger brother Dharmendra, also a Nepali Army soldier in December 2004 from his house in Deudhakala-9. Dharmendra, who was posted at Bhawani Dutta platoon in Surkhet, was on leave when he was abducted.

After the abductions of both his sons, Chet Prasad Adhikari has been knocking at the doors of various rights organizations appealing for help.

Similarly, Maoists abducted Niraj Yadav of Gulariya-2 on November 22, 2004 and Santosh Kumar Chowdhary, a 17-year-old eighth grader at Yuwak Secondary School in Jogigaon on January 28, 2005, according to INSEC representative Narayan Subedi.

Also abducted by Maoists are Ram Babu Regmi of Kalika VDC, Amrit and Birmi Khatri of Jamuni VDC, and Bhim Bahadur Bishwokarma, a resident of Syangja who had come to Balapur, Gulariya to meet his in-laws, according to Subedi.

Maoist ‘people’s government chief’ Bishnu Prasad Chowdhary said that facts related to the abductions will soon be made public.

Maoists abduct 3 including NC worker, govt official

KATHMANDU, July 5 – In a blatant violation of code of conduct yet again, Maoists abducted the chief of the Rajbiraj customs office, Tirtha Raj Khatiwada on Tuesday and a farmer in Dhanusha on Monday. The Nepali Congress said rebels abducted the party’s Rupandehi district committee member Astabhuja Pathak on Tuesday. The rebels also padlocked a government office in Saptari.

In Janakpur, Maoists on Monday abducted Ram Chandeshwor Yadav, local farmer of Balawakhar-7 in Dhanusha, while he was on his way to Darbhanga in India to buy medicines. In Saptari, cadres of Maoist-affiliated Terai Janatantrik Mukti Morcha, Tuesday abducted Tirtharaj Khatiwada, chief of the Rajbiraj customs office.

According to police, two cadres of the Morcha, who had come on a motorcycle, took Khatiwada away from his office to an undisclosed location that evening.

Similarly, the rebels Sunday in the same district allegedly forced Bhola Gohibar, head teacher of Tedhamor Lower Secondary School in the eastern district, to sign a contract paper. Gohibar said a group of seven Maoists manhandled him and forced him to sign the paper.

Meanwhile, seven political parties in the district accused Maoists of continuing torture, abduction, extortion and other activities. They also warned they would resort to “retaliation” if the rebels failed to stop such activities immediately. 

A report from Saptari said Maoists padlocked the office of Koshi Pump Canal Irrigation System, Rajbiraj, saying that the office violated the agreement signed between the parties and the Maoists at the local level.

According to Bimal, No 2 area secretary of the rebel outfit, the office was padlocked as the retired office staff, who were the supporters of the king, were reinstated instead of appointing others.

OHCHR concerned over Maoist killings, abductions

KATHMANDU, June 27 – United Nations High Commissioner for Human Rights (OHCHR)-Nepal Tuesday said that it was seriously concerned over the Maoists’ “continuation of killings and abduction” in the past few weeks.

In a statement issued here today, the OHCHR said, “at a meeting with the CPN-M leadership on June 23 and in a subsequent letter of June 26, OHCHR raised its concerns regarding a series of abductions and killings attributed to CPN-M cadres in the Central Region, which have resulted in the deaths of nine individuals since May 3.”

The OHCHR said it also raised the cases of two individuals who were reportedly abducted in Kathmandu and severely beaten in Kavre. “In most of the cases, the victims were accused of ‘crimes’ or ‘offences’ and were apparently under investigation.”

“OHCHR remains concerned, however, that civilians continue to be abducted and held by the CPN-M in spite of repeated expressions of concern by OHCHR,” the statement said.

OHCHR also said it has continued to emphasize in its meetings with CPN-M leaders that abductions of civilians for any reason are in violation of CPN-M’s commitment to international human rights standards. “These abductions and related investigations and punishment fail to provide even minimum guarantees of due process and fair trial. As a consequence, victims of abductions are vulnerable to other violations of their human rights, particularly their right to life and physical integrity, as in the noted cases.”

“Civilians and CPN-M cadres suspected of criminal activity should be turned over to the relevant state authorities so that they can be investigated and where appropriate, prosecuted in a timely manner in accordance with international due process and fair trial standards,” the statement quoted officer-in-charge of OHCHR, David Johnson as saying.

DPM Oli defends NA statement; criticizes Maoists

At a time when the statement issued by the Nepalese Army (NA) on the statement of Maoist chairman Prachana getting criticism from various quarters, Deputy Prime Minister (DPM) KP Sharma Oli has defended it and said, NA issued the statement as the government and the Defense Ministry could not take any initiation in this regard.

The Kantipur daily quoted DPM as saying that the remark of Maoist chairman Prachanda about the NA was not balanced and unsystematic.

He further said that such statement of Prachana might have negative impact in the talks.

Oli is also of the view that the media should not present news as it was spoken by Maoist chairman Prachanda in an unsystematic way.

Addressing a press conference after the high level talks with the leaders of seven political parties last Friday, Maoist supremo Prachanda had alleged the NA of doing nothing in its history other than killing Nepali people.

Prachanda alleged that Nepali Army had done nothing good except “murdering people and raping Nepali women.” The top rebel leader further said since the Nepali Army could not fight with India, China or the US, it should be reduced to around 20,000 from its present strength of 90,000.

In a statement issued on Thursday, spokesman of the NA, Brigadier General Nepal Bhusan Chand, said Nepali Army was seriously concerned over what it called objectionable comments and remarks made by the rebel leader “during the recent special government programme at an important venue which was telecast live all over the country and attended by top political leaders.”

“Nepali Army has—behind it—a history of over 225 years old culture of glorious nationalism, protection of territorial integrity and selfless sacrifice for people’s security. Nepal’s history is testimony to the fact that from the past to the present, the NA has always remained committed to protect the country’s sovereignty, territorial integrity and dignity of the people under the direct command of the prevailing constitutional government,” the statement added.

DPM Oli also added that Maoists are not only involved in development activities but also involved in raping women.

DPM Oli further said that he met with Chief of Army Staff on Friday as an acting Prime Minister and defense Minister.

The paper also quoted spokesman of the Defense Ministry as saying that the ministry is studying the statement of Maoist Supremo Prachanda.

NA trying to disrupt peace process: Minister Thakur

KATHMANDU, June 23 – Minister for Agriculture and Cooperatives and Nepali Congress (NC) central committee member Mahanta Thakur Friday accused the Nepali Army (NA) of trying to disrupt the ongoing peace process by issuing political statements.

Criticizing a statement issued by the NA on Thursday in which the army expressed "serious concern" over "misleading" comments by Maoist Chairman Prahcanda about the NA at the Prime Minister's Residence recently, Minister Thakur said, "The NA should not speak out against an individual."

Thakur made the remarks at an interaction programme in the capital on Friday.

"The NA issued the statement on its own after the Defence Ministry refused to issue it," Thakur said, adding this could send a negative message to the Maoists and "disrupt the peace process."

He also said that it was "inappropriate" for the army to issue such statement at a time when the Defence Minister was outside the country.

"The government's reaction will be made public after Prime Minister Koirala, who also holds the Defence Ministry portfolio, returns to the country" Thakur added.

PM Girija Prasad Koirala is currently in Bangkok for medical treatment.

Minister Thakur also said that the "monarchy, which has always conjured up controversies" was no longer needed.

"The NC has already removed all references to the king and monarchy from its statute so there will be no place for king and monarchy in the Constituent Assembly elections," Thakur said.

Issuing a statement on Thursday, the NA said it was "seriously concerned over objectionable comments and allegations" made by Prachanda at the Prime Minister's official residence in Baluwatar on June 16.

"The Nepali Army is seriously concerned over objectionable comments and allegations from Maoist chairman during the recent special government program organized at an important venue, which was telecast live all over the country and attended by top political leaders," a statement issued Thursday by NA’s Brigadier General Nepal Bhushan Chand, said.

On June 16 Prachanda had said the NA is good for nothing except "murdering people and raping Nepali women". The Maoist chairman also said that the 90000-strong NA should be reduced to 10,000 or 20,000.

50 textile industries closed in Birjung

Nearly 50 textile industries of Birjung closed down from Thursday for an indefinite period due to the dispute between management and trade unions.

Birgunj Chambers of Commerce and Industries (BCCI) decided to shut down industries for an indefinite period after the trade unions did not come for talks to find amicable solutions of the issues of appointment letters, minimum wage and formation of new labour act.

The BCCI had asked the three large trade unions, Nepali Congress (NC) affiliated Nepal Trade Union Congress, CPN UML affiliated General Federation of Nepalese Trade Unions (Gefont) and NC (Democratic) affiliated Democratic Confederation of Nepalese Trade Unions to come for talks within 72 hours on Sunday and warned of industrial shutdown if they failed to respond to its call for negotiations.

The trade unions refused to take part in the talks citing the threatening tone of the chamber. On the other hand, the BCCI said that the chamber was forced to issue such a warning note after trade union officials showed indifference to its repeated calls for talks.

Some industries of the area had shut down operation as soon as the trade unions submitted their demands to the management.

Meanwhile reports quoted Confederation of Nepalese Industries as saying that Gorkha Brewery of Nawalparasi and Himalayan Snacks and noodles of Kavrepalanchowk were also closed from Thursday due to the dispute between the management and trade unions. nepalnews.com pb June 23 06

Man commits ‘suicide’ in Maoist detention

Kantipur Report

DOLAKHA, June 23 – Shiva Khadka, 38, of Malu VDC-3 in the district, arrested by Maoists two weeks ago on charge of murdering his wife and kept in their "custody", was found dead.

According to Bishal, secretary of area number-1 committee of the Maoists, Khadka had managed to escape from custody Tuesday. According to him, next day he was found hanging in the same tree where he had allegedly hung his wife, Devi Maya, after murdering her.

The Maoists also claimed that Khadka had confessed killing his wife during interrogation. "As he was depressed in the latter days, we were constantly mixing him up with local villagers," he said.

When human rights activists, journalists and members of civil society reached the incident site to investigate into the "suspicious death", Khadka's body was already consigned to flames. Relatives of the deceased had carried out the funeral rites after the Maoists said that they collected the first information report.

When contacted, police expressed lack of knowledge about both deaths.

Nepal:Maoists Killed A One Year Old Baby

1. In western Nepal, on June 14, 2005, Maoists killed an infant. Three of the victims have been identified as the wives of Armed Police Force personnel. A one-year-old baby is also among those killed. The six were abducted in western Nepal and their bodies were found in a forest.

2. Five persons are killed when the Maoists attacked a RNA base camp and the Panauti municipality office in Kavrepalanchowk district. (February 7, 2006)

Nepali people continue to fall victim to their barbaric acts. Maoists war enter a stage of genocide. It is unacceptable to let innocent people be killed in the name of Maoists. Maoists is a theoretical threat to Nepal's democracy and civil liberty. Nepal could turn into another Cambodia, Afghanistan, Bosnia or Rwanda.

Radical Maoists are attempting to preserve their killing culture from contamination. Nearly ten years of Maoists war have left roughly 15,000 Nepalese dead.

"The Maoists have links with similar groups in India, including the People's War in Andhra Pradesh and the Maoist Communist Centre in Bihar bordering Nepal. The Maoists plan a compact revolutionary zone stretching from northern Andhra Pradesh through central and eastern India to Nepal. This will not only offer a mutual moral support but also help them procure and distribute weapons illegally.

Insurgency in Nepal can have its impact in Indian states such as Bihar, West Bengal and Jammu & Kashmir as well, particularly if more weapons are delivered by foreign powers to militants clandestinely. The Maoists' struggle may even spill over to Bhutan. The cross-border linkage of the Maoists poses a great threat, now that they have become a major force in Nepal. But India's military power can ensure that the spillover of the Nepalese insurgency in under check within its territory.

In India, Andhra Pradesh state has brought forth a fairly lasting ceasefire with its insurgency group and talks are on. As a bigger power, it would be safe for India not to get into a quagmire of a neighbour, except for giving military support if needed. Of late, the policy of India towards Sri Lanka is the same, and that is why Norwegians have come in as mediators.

The Maoist insurgency in Nepal has claimed over 15,000 lives since it began in February, 1996. It now affects 73 out of 75 districts. The rebels have raised their own guerrilla force, militia and parallel government units in their strongholds. They also operate parallel people's courts and are preparing to implement new Maoist-oriented syllabi in schools in their strongholds. This has made the Government dysfunctional in almost all of western Nepal.

A negotiation with maoists depends on a give and take. Or else, the options are (i) rapid development of rural Nepal (underdevelopment being the fertile ground for militancy) or (ii) militarily eliminating the Maoists or (iii) a combination of both." Chief Sub-Editor with The Hindu, and advisor of PJ Dr. I Arul Aram said.

It is true, the Communist groups in the Universities and in the schools during the 70's tried for a Marxist revolution and failed. By tradition, the power behind any communist revolution was rejected. After that they then tried for black support, but again they were rejected. They then used the Vietnam War and Shining Path, that too disappeared. Lacking support, the movement apparently faded away.

The fact is that the Nepali Maoists are members of the International Revolutionary Movement (RIM). Nepali Maoists have joined the Coordination Committee of Maoist Parties and Organizations of South Asia formed in 2001.

Maoists And Combodia

Radical Maoist movements have failed to take power in Peru, but Khmer Rouge seized power in Cambodia and their tactic was to terrorize the countryside by setting up ambushes and seeding minefields. The Khmer Rouge regime traumatized millions of Cambodians and it created a permanent scare in every Cambodian citizen. A lot of individuals died because Pol Pot was too incompetent to deal with economic and social development in the country.During the 1975-79 rule of the radical Maoists at least 1.7 million Cambodians died due to disease, starvation, overwork and execution. There was no banking and finance, no private ownership of property, and no religion.

Peru And Maoists

During the 1980s, the Shining Path, waged an armed struggle against the Peruvian state. Approximately 30,000 Peruvians were killed. Shining Path Maoists organization was formed in the late 1960s. In the 1980s and early 1990s, vicious terrorist attacks were daily occurrences across Peru perpetrated by the Shining Path. Many dozens of people have died under Maoists violence. Now, all the leaders of maoists organization are in prison.By 1994, Shining Path had lost much of their strength. According to the Mesa Nacional Sobre Desplazamiento, a consortium of non-governmental organizations, the conflict displaced some 430,000, but "affected" as many as 1.6 million. Some 60,000 people remained internally displaced within Peru. Hundreds of thousands of Peruvians fled their Andean homes in the 1980s and early 1990s. They fled a violent insurgency.

Hope is Not a Method

The most pressing danger is that the Seven Party Alliance will revert to form and lead Nepal into a 'Kerensky moment' for the Maoists, as occurred with the Bolsheviks in Russia in 1917-18

As Nepal moves towards a new order, its governing parliamentarians would do well to heed that most fundamental of maxims: hope is not a method. To date, events have gone reasonably smoothly, but there continue to be ominous signs that a rougher road lies ahead. Not least of the elements for concern is what has been at the heart of the matter all along: the motives of the Maoist insurgents.

Contrary to much ill-considered opinion, the Maoists have not opted for peace in our time. Instead, their forces remain intact, even as they encourage the Government to dismantle the only surviving force that stands between the Communist Party of Nepal – Maoist (CPN-M), and its ability to work its will, the security forces.

Their grudging moves towards negotiations notwithstanding, the Maoists have been very consistent. In their verbiage, in their briefings to their cadres, and even in their interviews given to members of the international media, they make clear that they do not accept the present state of things and remain convinced that they are riding the "will of history" that will see the complete ouster of the old order.

The Maoists view the present course of the Seven Party Alliance (SPA) as an error of major proportions and are fearful that 'the people' will be 'betrayed'. They certainly do not accept parliamentary democracy as the end-state, unless it emerges in a form of which they approve.

What stands behind their present tactical maneuvering is a willingness to go with the flow so long as the river does not leap its banks. If the SPA will do the work that armed rebellion could not accomplish – especially, dismantle the security forces and do away with even a figurehead monarchy – that is agreeable. But one cannot expect them, if things do not go their way, simply to shrug and say they had their moment.

There is a veritable cottage industry of historical falsification abounding, in Nepal and abroad, producing the fiction that the Maoists turned to insurgency only because they were not allowed to participate in 1991 parliamentary elections (as Masal). That is false. The machinations that led to one wing of Masal being allowed to run using party identification were an intra-Masal squabble, not something the system engineered.

Likewise, the outrageous claim that the monarchy is somehow responsible for the violence of the Maoists is as astonishing as it is absurd. The Maoists first systematically laid waste to Nepal and its weak democracy, then systematically carried out a campaign to claim the reigning monarch had killed his brother and engineered what they, the Maoists, had in fact done – destroy Nepal.

Having turned to armed insurgency, CPN-M methodically destroyed the structure of the state, in the process eliminating all who opposed the local presence of the Maoists. Having gained control of widespread areas, which they will continue to control during any proposed 'elections', they are not about to allow their rivals to freely contest within 'liberated space'.

This is classic "machine politics", as the Maoists claim the Nepal Congress (NC) and Communist Party of Nepal – United Marxist Leninist (CPN-UML, or simply UML) have been playing all these years. Since UML buys into this logic, at least partially, it is willing to front for the Maoists. The extremist wing of the UML does more than front – it works with the Maoists.

Ironically, anti-communist India has ended up letting its own Marxists have their moment by unduly influencing New Delhi's Nepal policy. This should not surprise, given the realities of coalition politics. With its dependency on the Left Front, particularly the Communist Party of India Marxist (CPI-M) in Parliament, compounded by divisions within its own ranks as to the proper policy towards Nepal, the Congress-led Government has acceded to the CPI-M demands. As a consequence, CPI-M figures such as Sitaram Yechury have become regular visitors to Kathmandu as they conduct the Indian Left's 'foreign policy within a foreign policy'.

The issue of Indian policy or intervention is not one that need detain any analysis at this moment. It will ultimately be decided, one way or another, as it was in Sri Lanka, by nationalism in the target state. Nepali nationalism, to be sure, is something, which has rarely reared its head in anything save platitudes about "never having been a colony". In fact, Nepal is as thorough a colony as ever there was (of India and of the international community through its utter dependence upon external aid).

Still, to be clear: first, India has no desire to become bogged down in the Nepalese quicksand, so having 'democratic allies' in power is the proper route to realization of its geo-strategic designs; second, there is a strong wing of Indian politics that sees the present policy towards Nepal as misguided, counterproductive, and downright dangerous, given India's own Maoist threat. The claim that there are no connections between the Nepali and Indian Maoists is falsified by a wealth of evidence, not least the pronouncements and actions of the Nepali Maoists before they became more media savvy.

The threat to Nepali sovereignty, then, is not from India per se but from the present situation that India has 'enabled'. Its view is that it can 'handle' the situation. This remains to be seen – just as India proved quite incapable of 'handling' the Tamil insurgents in Sri Lanka .

The most pressing danger, at this juncture, is that SPA, dominated by NC and UML, will revert to form (on full display during the dozen or so years of full democracy) and lead Nepal into a 'Kerensky moment' for the Maoists, as occurred with the Bolsheviks in Russia in 1917-18.

The Leninists were not the strongest party in post-Czarist Russia, only the party with a preponderance of force at the decisive point(s). This allowed them to gain control of the state and then to do what was necessary to consolidate their hold. This is also how Hitler consolidated his hold on Germany, despite having only one-third of the Parliament (Reichstag). It is what the Sandinistas did in post-Somoza Nicaragua. One already sees the Maoist thugs threatening even UML politicians (who, in any case, have always been on the cutting-edge as victims of the Maoists). What all the preceding cases share is that the security forces had fallen apart. This is not yet the case in Nepal.

The key, therefore, is to make the new-order understand that the security forces have every intention and desire to serve democracy – and that they will not stand by and see restored democracy and Nepali sovereignty compromised. The Maoists, however, have stated repeatedly that they have other goals: trials for those central to the old-order, especially for the monarch and the Royal Nepalese Army (RNA) officer corps (the Maoist leadership has asserted both of these goals in its less guarded moments). This is also what they have been saying to their cadres.

They have rejected integration into the RNA by any name and demanded a new National Army, which they will dominate by default. This is just how the scenario played itself out in Nicaragua, the result being the Sandinista dictatorship, which rapidly produced its own counterrevolutionary insurgency by abusing the people. (Contrary to the hoary left-wing myth, the CIA could not even arm all the contras, so abundant was the influx of peasant manpower demanding the right to resist the Managua Marxist-Leninist dictatorship). In this situation, what is both puzzling and counterproductive is how little realistic consideration has emerged concerning the future of the security forces, of which the RNA is the dominant element.

This is puzzling, because the security forces are quite intact and – contrary to yet another theme pushed by both activist elements of the new regime and their international activist backers – exercised remarkable restraint during the recent mass agitation. Lathi charges and rubber bullets are not semiautomatic volleys, and the latter did not occur. There are at least 150,000 armed Government security forces in completely intact units. It is naïve to assume that they are going to march off to oblivion, surrender, or slaughter. The last two options are what the Maoists envisage, and what they expect to extract from the ruling SPA as their price for 'nonviolent participation' in the state. To judge that this inevitably will lead to confrontation requires no analytical acumen – simply looking at the Nepali security forces with clear eyes. What is now on the field is a force quite different from that, which entered the conflict in November 2001, when the RNA was attacked by the Maoists. This is especially so in the key middle grades and extending even to the younger brigadiers. It is also true in the Armed Police Force (APF), perhaps to a lesser extent in the Nepal Police (NP).

The RNA's 'field elements' now accept parliamentary supremacy and seek a more professional, '21st Century military'. Officers know there are numerous friendly states with extensive experience in implementing and consolidating the proper mechanisms. Many of these younger RNA officers have even considered the passing of the monarchy, but they are worldly enough to see that this leaves open the question of what institution or figure would serve the referee's position. Hence, they believe it is preferable that a constitutional monarchy remain. What they do not accept is the position demanded by the Maoists and their left wing allies: 'replacing' one force by another, or of 'purging' one force only to install the cadres of another.

Reconciliation, to their mind, demands amalgamation, even if this is accompanied by reduction in overall numbers. Under no circumstances will any force accept being disbanded in favor of Maoist replacements. To do so would guarantee left-wing dictatorship. For their part, APF and NP are critical to the normal law and order of the state. Ironically, whatever the precise manner in which events unfold, the sitting Government is bound to find, in the months ahead, normal policing and security duties will assume heightened importance. A clear understanding must be worked out by the Government as to what is expected to arrest a dangerous societal drift that has set in. Armed thugs, often claiming to be representing 'the people' but invariably cadres of Maoist front organizations, roam all major population centers in Nepal and must be brought within the normal rule of law. This is a job particularly for the Police, supported by the APF, but it is inevitable that RNA will be involved. The present situation, including the widespread intimidation of individuals and institutions, cannot go unchecked. Politically, RNA is confronted with a Faustian bargain: It must serve the state even with the knowledge that the unity of SPAM (Seven Party Alliance + the Maoists) depends upon the SPA placating the Maoists. The Maoists see the victory as theirs and see themselves as dictating the terms of surrender – and envisage only trials for those who have resisted them. Hence, the security forces must keep order even as they are plotted against (in certain circles) and held up as a bargaining chip (in others).

Their logical advocates, the Indians, who have the most to lose from a Maoist-dominated Nepal, remain very much an unknown element, given the array of actors waging mini-foreign policies. One factor has not changed as any perusal of large segments of the Indian press reveals: New Delhi has been ill-informed by a good fraction of its so-called 'Nepal experts', in just the manner it was led astray, two decades ago, by its 'Sri Lanka experts'. It cannot be said that Indian analysts have developed much actual knowledge of the workings of Nepali Maoism.

The dominant position is that the CPN-M can be bought off or simply directed – an astonishing position given what India seems to have realized quite belatedly the Stalinist, anti-democratic essence of its own Maoists. The CPI-M, in particular, has little comprehension of Nepali insurgent ground realities. The Indian Left Wing political pilgrims to Nepal deal with their opposite numbers in the UML. If they meet a 'Maoist', they deal with personalities of their 'own stratum', who can be as engaging and sophisticated as any.

They do not deal with what is in the hills, thus gaining no comprehension that there is an organization of LTTE clones, every bit as dogmatic and ruthless. For those who have dealt with the Tamil insurgents, one conclusion is salient: the orientation of manpower is never the issue in a situation such as this. It is leaders who are the lynchpin, who produce the endless cycle of insurgent brutality in Sri Lanka, a struggle that has long since seen its original causes vanish. The situation in Nepal is similar. It is the Maoist leaders who are following an ideological play-book; their followers are thrown up by local grievances.

Maoist manpower is just as eager for 'peace' as anyone else, but they expect to get something out of their campaign. They have been told consistently that the new order will belong to them and will bring justice and prosperity. There is no way to do that in the short term except by taking from the old and giving to the new. That this is playing a losing hand has been made clear in study after study, most recently by the simple but telling calculations of Dr. Steve Gorzula. As he notes: divide the arable land of Nepal (22,627 km2) by the population (28 million in July 2006 estimates), and the result is a society that has exceeded the carrying capacity of the land. Lip-serve is paid to the only real possibility – development of hydropower – and the result is a vacuum in which Maoist coercive utopian solutions have no competitors. Lenin would certainly be proud of his Maoist pupils. On the side of democracy, however, there is little worthy of praise. The stormy course ahead will require more steady seamanship than has hitherto been demonstrated in the short history of Nepali democracy. More than 'hope (it all works out)' will be required.

The role of the security forces will be paramount, for they are the only guarantee that Maoist violence will not be the trump card. Thus normal functioning of those security forces will have to be maintained at all costs, so as to avoid demoralization and possible desertion. Clear explanations of what is happening are imperative, with the emphasis upon 'transition to parliamentary supremacy'. Any impression of 'defeat' must be banished, despite the concerted efforts of the Left Wing to push this claim in the ongoing struggle for control of the narrative describing recent events. Already, the Maoists claim their revolutionary forces were the key in the recent agitation (their cadres did incite violence and cache explosives in urban areas).

'Reform', then, must be the order of the day, as has long been called for by all interested parties, but this word finds no place in the Maoist vocabulary. Consequently, forces of actual democracy (as opposed to 'people's democracy') will be called upon to face the inevitable backlash. It is for the politicians to deal with this reality, and the security forces can be their shield.

It is possible that international mediation and even involvement may create new possibilities. For the moment, however, the Maoists have no intention of participating in a new version of the old-order. They are demanding and expecting that a constitutional convention will deliver a people's republic in form if not in immediate practice. They are determined to exact vengeance.

They are not, in other words, seeking 'democracy' as we know the word. There is a strong thread of thought which claims the Maoists will choose the path trod by the 'other' insurgent groups in Sri Lanka (e.g., People's Liberation Organisation of Tamil Eelam, Tamil Eelam Liberation Organisation, Eelam People's Revolutionary Liberation Front), groups that agreed, with certain misgivings, to work within the system. More likely, the Maoists will go the way of the LTTE that, after each hopeful pause, resumed its revolutionary project.

It hardly needs highlighting that such a course of action by the Maoists would put them squarely at odds with the desires of the Nepali masses – just as LTTE cannot today be said to represent much more than the aspirations of its rump state. If the CPN-M is astute, it will realize this. Unfortunately, history does not provide grounds for optimism. There is no Maoist insurgency that has displayed such foresight. Neither do operational realities provide any more hope: the Maoists are not in any way standing down.

The up side? If the Maoists move as driven by their hate-filled ideology and resume their struggle, they will find themselves just where LTTE is – on the wrong side of history and facing a reasonably united, democratic society, amply assisted by friendly powers, including India.

Nepal: Why I Support The King

By Sagar Mani LamsalA supporter of King Gyanendra's seizure of absolute powers on February 1, 2005 is inevitably criticized as being at least one of the following:

- A scion of the Rana-Shah oligarchy – genealogical or other wise — congenitally bent on subjugating the vast majority of impoverished and underprivileged Nepalis;

- A superstitious misfit who still sees the king as an incarnation of the Hindu deity Vishnu;

- A beneficiary of the palace payroll aiding and abetting the restoration of full feudalism;

- A remnant of Nepal's palace-led authoritarian past seeking to regain powers and privileges lost in the democratic upsurge of 1990.

As someone who does not fit into any of these four categories, I have decided to create a fifth: a foot soldier in Nepal's war of independence. It is in this spirit that, despite all the gloom and doom hovering over the kingdom, I detect something positive is about to happen regardless of how the conflict plays out.

The tripolar conflict between Narayanhity Royal Palace, mainstream opposition parties and the Maoist rebels is essentially a struggle for the future of Nepal. (I'm sticking with the term "tripolar" because I'm not sure how far the political parties and the Maoist rebels have actually bridged their differences.)

I certainly cannot claim to imagine the horrors those caught on the frontlines of the conflict have experience for no apparent fault of theirs. I can only hope and pray that the sacrifice of the murdered and maimed will not have gone in vain.

The Maoists have brought out the deep political, economic, social and cultural inequalities that have struck ever deepening roots under 236 years of monarchy. In their ardor to blame the king for this reality, the Maoists have let out another side of their thinking. Maoist literature recognizes that Nepal's stagnation is a product of its special form of partial incorporation as a semicolony of the British Raj and subsequently within the political economy of India. This experience, in their words, has ensured a degree of forced stagnation in the production and productivity which led to increased popular pressure on marginal land, emigration and ecological decline.

In seeking to redress these grievances, they have unleashed ancient hatreds to a dangerous level. Destruction and devastation, in the Maoists' view, provide the foundation to build anew. But do they have the ability to sustain even what would remain, much less build anything. Can they expect to retain power – much less initiate their radical programs? In recent months, they seem to have lost the spine to go head on against the monarchy.

Having joined peace talks twice under a king whose enthronement they so severely denounced, the Maoists have swung the other way. Their 12-point accord with the principal parliamentary parties to restore total democracy has raised more questions than it has answered. The circumstances in which they signed the accord have deprived them of their other novelty: the willingness to resist Indian pressures and practices. At least the mainstream parties are honest about their attitude toward Nepal's southern neighbor.

Girija Prasad Koirala, Madhav Kumar Nepal and all the other leaders and followers in the seven-party alliance now arrayed against the palace aren't gripped by some sinister compulsion to ruin the country through perpetual protests. Indeed, they believe the way forward for Nepal in today's day and age can only be by empowering the people.

They may believe the monarchy is the principal obstacle to Nepalese democracy as they envision it. But in their heart of hearts, do they still have doubts about their ability to hold the country together in a post-monarchy environment? Is that why alliance leaders worry in private conversations about the "vacuum" that might grip a small nation perched strategically between Asia's two giants? Is this why, like the Maoists, they have not been able to even articulate what total democracy is?

On the face of it, the mainstream alliance's belief – and even the Maoists', for that matter — in closer cooperation with India cannot be considered inimical to Nepal's interest. There is full merit their argument that Nepal cannot expect to go on receiving Indian concessions without offering reciprocal pledges on major concerns of New Delhi.

Logically, the new realignment created by the mainstream-Maoist accord should have spelt the end of the royal regime. The reason King Gyanendra remains unperturbed – at least in public — is because he recognizes that "total democracy" is not the real reason Indian engineered this union.

I personally believe the Indians do not want to do away with the monarchy. If King Gyanendra acceded to Indian demands on a broad package of concessions – I am personally convinced that such a proposal would not differ much from the versions New Delhi tried to impose on King Birendra and interim prime minister Krishna Prasad Bhattarai – New Delhi would once again hail King Gyanendra's wisdom, experience and maturity in the same awed tone editorial writers used in the weeks and months after his enthronement four years ago.

For me, the king's game plan is clear. He is too smart to expect to monopolize power the way his father and brother did. But, then, he is not ready to retain the throne without the freedom of action his vision of the monarchy demands. King Gyanendra has made up his mind to wage Nepal's war of total independence. The cause of this war is what inspires me.

King Gyanendra's opponents don't need to stress the obvious. The royal government is autocratic, packed with yes-men and devoid of creativity. The lack of representative institutions at all levels has made the palace unaccountable. Royal relatives and hangers-on are abusing their power and privilege in a way the democratic leaders never could. This, to me, is a price worth paying.

Why is the government is going after the media? Actually, it is going after only one media house, Kantipur, which has been more responsible than any political party for subverting democracy. (The raid on Sagarmatha FM was merely a reflection of the royal government's resolve to implement the law. In the government's view Prachanda is still a terrorist, and the law forbids anyone to encourage terrorists.)

What kind of newspaper would report that the Maoists, in a massive extortion spree, had sought "donations" from its publishers but then hold back the fact that they had paid off. The Maoists had the decency of returning the day the story appeared to return the money. What kind of publisher or editor would carry Dr. Baburam Bhattarai's plea for a military uprising against the new king amid such grave national crisis? Probably one attuned to the traditions of the subversion and subterfuge of Indian journalism practiced against its neighbors.

No doubt, the public had a right to know what the chief Maoist ideologue thought about the royal massacre. Dr. Bhattarai may have had his own agenda in lavishing praise on each one of King Gyanendra's predecessors in the Shah dynasty while singling out the new monarch for calumny on the basis of hearsay and rumor? Was it so difficult to see through the Maoist propaganda?

How many Indians from Assam, Almora, Darjeeling and Meghalaya masquerading as Nepalis dominate Nepali newsrooms to spread Indian venom against Nepal in the name of a free press? Why are publishing houses with hefty property interests in India – including massive income-tax defaults – the most critical of the royal regime?

And the code of conduct for non-government organizations? Again, this was the way the United States and European imposed their color-coded "revolutions" in Georgia and Ukraine. Weeks after the Nepalese government issued the NGO code, the Kremlin came out with similar restrictions. One autocrat emulating another? Or two countries comparing notes to protect their flanks?

The royal regime cannot expose the charade because of King Gyanendra's core dilemma. His strongest loyalists are incompetent and the most competent people on his side have the temptation and tendency to become the most disloyal.

But, then, King Gyanendra is too shrewd not to understand the space history and geography have provided him. His plan to develop Nepal as a transit point between the rapidly growing economies of India and China has prompted much ridicule from his detractors, but it worked for Nepal – or at least Kathmandu – in the past. What the Malla kings could do for Kathmandu is entirely within grasp for the entire kingdom.

Nepal has reached a critical crossroads. The stakes are much higher than determining whether Nepal remains a monarchy or becomes a republic. Basically, this is the challenge: Nepal can either be truly independent of or truly dependent on India.

If India wants Nepal to be firmly in its sphere of influence let it incorporate the kingdom as a full member of the union. Having secured its foothold on Nepal's strategic position and established full control of its water resources, New Delhi can lay the basis for a healthy center-state relationship. Ordinary Indians would be startled to discover the commonalities Nepalis share, given the negative image their media have consistently portrayed.

But Nepalis must be assured of the full benefits of formal integration. We would need Central Police Reserve Force to step in to quell unrest. Natural disaster victims would require the full deployment of the relief and rehabilitation of the Indian machinery. Political representation in the Lok Sabha could be worked out in accordance with several factors that assuage concerns of underrepresented social, ethnic and linguistic groups. Indeed, India's current political map might have to be redrawn to optimize integration with bordering Indian states.

Indeed, some communities in Nepal may resist formal integration with India more violently than others, but then that is a price India has been paying in half of its states for more than a half-century.

If that is too high a price for New Delhi, then it must grant Nepal full recognition as an independent and equal partner. Nepal would enjoy the sovereign right to develop its own political and security ties with China, Pakistan, United States or any other country as it deems fit.

India would also need to fully respect Nepal's economic sovereignty. Why should Nepal have to go to such lengths to invite third-country investors like Kodak only to have them leave after India reneges on its promise of full market access? Bilateral treaties should hold the full force of law. If free and unrestricted trade is guaranteed by both governments, why are Indian state governments allowed to step in to impede commerce. Specifically, why do Vanaspati Ghee, zinc sheets, nails and bolts – a handful of Nepalese products that sell well in India – come under the periodic entanglements of Indian trade and commerce regimes?

King Gyanendra's roadmap is aimed at consolidating Nepal's sovereign options through closer integration with China. The first direct passenger bus service linking Kathmandu and Tibet began weeks after the royal takeover, although it has now stalled amid procedural hurdles.

Efforts at developing Nepal as a transit point between China and India have received a fresh impetus. Nepal expects to provide the transit facility with the objective of expanding its service sector and physical infrastructure development. A Nepalese government study has identified three alternative routes linking the three countries.

Chinese delegations have visited Kathmandu to expand cooperation in investment, tourism promotion and infrastructure development. Nepal expects China's modernization of Tibet will assist the development of its own mountainous northern districts. Specifically, the kingdom hopes to benefit from a railway project linking China with Tibet’s heartland. Chinese officials say the railway will bring in 5.64 million tourists to Tibet over the next five years. The Lhasa-Kathmandu bus service is likely to benefit.

Kathmandu is planning to set up a special economic zone in its north with Chinese cooperation. Both governments will have special laws, special taxation structure and special investment policies in an effort to ease the access of Nepalese products to Chinese markets.

Nepal and China have taken special interest in developing the kingdom’s vast hydro-electric power potential. China and Australia will invest in West Seti Hydropower project, the biggest hydro-electric project of Nepal with the capacity of 750 megawatt,
the Chinese news agency Xinhua reported recently.

The $1.2 billion project is scheduled for completion within five and half years. The power generated will be sold to India, yielding $29 million in the first year of operation.

The war of Nepalese independence has begun – never call retreat.

Why The US Support For The King Of Nepal Is Important?

Dr. Khagendra ThapaNepal has been fighting the violent communist insurgents for the last nine years. After two failed attempts to have a negotiated settlement of the dispute between the government and the insurgents, the violence inflicted by the insurgents against the innocent citizens of Nepal has escalated. More than 11,500 lives have been lost as a direct result of the conflict and another 23,000 have committed suicide because they could not bear the pain of loss of relatives and the property owing to the conflict.

The supposedly democratically elected government was highly ineffective to fight the insurgents because the elected politicians including the prime ministers were extremely corrupt. According to Jana Dharana, a weekly newspaper published in Nepali language, in the course of last fifteen years, the elected criminal politicians, stole Rs.92,000,000,000 that is equivalent to US $1.5 billion. It is believed that the money donated by friendly countries to fight the terrorists was also siphoned away by the elected government. The country side is just about completely controlled by the insurgents.

The elected criminals were only interested to swell their bank accounts. They had absolutely no interest in the welfare of the poor people. The per capita income of Nepalese people has actually gone down after 1990 (was $265 and now it is $213) when democracy was introduced in Nepal. The elected government not only failed to control the violence from terrorists but they also refused to hold general elections. The government was ineffective, corrupt, and failed to maintain the law and order. There was anarchy in Nepal instead of the rule of law. The newspapers and other news media had become the mouth piece of the terrorists. The terrorists were also able to use the cell phones, internet, telephones, and FM radios as a means of communications. They were using the media to issue threats against the people. Insurgents were about to take control of the whole country including the capital.

Under these circumstances, the King Gyanendra of Nepal had two alternatives: one to give up the power to the insurgents and let Nepal be another Cambodia or dismiss the corrupt government and make a last minute attempt to save the thousands of year old monarchy and also protect the fundamental rights of the people to live freely without the atrocities of terrorists. Had he chosen the first track and given up the power to the insurgents and leave the country and the people at the mercy of terrorists, then definitely the insurgents would have killed millions of innocent Nepalese people including the corrupt politicians.

Fortunately, King Gyanendra decided to stay in the country and fight back both the insurgents and the corrupt elected criminals who were indirectly supporting the terrorists. Please note that the one of the coalition partners of the dismissed government was communist party (Marxist, Leninist). I believe that King of Nepal is making a last minute attempt to save the country and people of Nepal from the violent take over by the insurgents. It is a very risky attempt. If the King fails, Nepal will turn into another Cambodia and at least a third of the people of Nepal (that is, 8,000,000) will be killed.

Therefore, it is very critical that the US and the Western countries must support the King. The Nepalese King has put both his life and his throne at stake. He has no choice but to succeed. The takeover of the power by the King was widely supported by all sections of the Nepalese society. There were huge celebrations through out the nation in support of the King?s take over. Therefore, it is unwise and unhelpful to withdraw the support and military assistance to Nepal. If the military assistance is stopped for Nepal, it is extremely likely that the ruthless terrorists will take control of Nepal and turn it into an international terrorist?s hub. I understand that a group of Nepali Diaspora living in the USA and Western Europe are against the King of Nepal. They are indirectly lobbying for the insurgents. Nevertheless, it is wrong for the US government to listen to a select few individuals who are looking for the best interests of their power hungry corrupt friends and relatives instead of the destitute people of Nepal.

It has been observed that huge peace rallies supporting the actions of His Majesty the King of Nepal have taken place in Washington DC, New York, Sidney, Australia, and even in New Delhi, India. It is estimated that over 73% of the people of Nepal support the Feb.1, 2005 actions of the King.

According to the information received from Nepal, the security situation in Nepal has improved significantly after Feb. 1, 2005. The insurgents have lost badly in the battle fields. In western Nepal, over 200 insurgents were killed in a major battle. Various newspapers in Nepal have reported that the insurgents have started fighting among themselves. It indicates that the time for peaceful Nepal is not very far.

His Majesty the King has already proclaimed that he will ensure that the local government elections are held within a year in all municipalities. This is another proof that the King means what he says and he will restore democracy within the next three years as promised if not before. If the security situation improves, it is in the best interest of both the king and the country to hold the general elections and form an elected government. One can bet with certainty that the political leaders will oppose any kind of election in Nepal. It is because they will loose the election big time. Having looted the people for the last fifteen years they do not have the guts to go to the people. Therefore, they want to revive the dead parliament so that they could be members of parliament for life. It seems these leaders are taking lessons on democracy from Egyptian president Hosni Mubarak.

Mahara warns of talks breakdown if parliament is not dissolved

Maoist spokesperson and coordinator of the peace talks with the government, Krishna Bahadur Mahara, has warned the peace talks may be stalled if the government does not dissolve the parliament soon, reports said.

Mahara was addressing a press conference in the far west town of Dhangadhi on Tuesday. He said, "Parliament should not be allowed to continue any longer. A majority of those who revived democracy are not represented in the current House of Representatives (HoR). As such, it should be dissolved within a week."

He asked the media persons not to raise doubts about the success of the peace talks. "The CPN-Maoists will not be a factor in the failure of peace talks this time," he said.

The Untold Pains of Nepal

Introduction

1.Both India and Nepal are independent and sovereign countries. The unique relationship between these two countries is based not only on a diplomatic and political level but also on the level of common people.

The geographical proximity holds a unique significance as Nepal lies on the southern slope of the Himalayas and all the rivers from Nepal flow towards India. Thus, it is customary to have more transactions in industry and trade sectors because of geographical structure.

2.India is Nepal's closer neighboring friend. Nepal is one of the most beautiful nations located on the southern sunny lap of the Himalayas, stretching from east to west. It is sandwiched between the Tibetan autonomous region of the People's Republic China in the north and the Republic of India in the south, east and west. Nepal is only the Hindu kingdom in the world having equal respect to all religions, traditions and cultures.

3.Though India is a good friend, Nepal feels dominated in several issues. The issues in brief are stated below. The issues that Nepalis are facing are untold stories of Nepal that any government in power does not venture to express to the fellow friends of the world. Even NGOs, Journalists, Civil Societies and communities Development Organizations do not dare to express openly and freely due to many reasons. When Nepal is in a weak and fragile state it is exploited ruthlessly. For example when Nepal in these days is in a movocratic rules, extreme conflicts and terrorisms a road is being constructed by Indian BSF in Nepali territory in the Susta area in central Nepal. So were grabbed Nepal's water resources and many other things during critical political and administrative situations.

Territorial issues

1.Open border

The peace and amity treaty of 1950 proposes an open borders system between two countries. Because of the open border, the citizen travels from one country to another without visa, and without any record in spite of the problems created by the open border; India is not ready to resolve it. India is willing to continue open border even at the cost of its loss. It is India's vested and vile interest.

The open border has resulted in various problems. Social evils are enlarging day by day. Let me trace some of them in brief.

Nepal has been the centre for various kinds of Indian criminals (smugglers, embezzlers and dacoits), who frequently break law and order by creating turmoil. Them taking shelter in border area intensifies theft, robbery, killing, and looting in Nepal. Such criminal activities cause harm to every national and local election and thus weakening democratic practices in Nepal. The BSF gives security to the criminals, who freely carry out their activities and give trouble to Nepalis. The month long mass rape in several VDCs, including Biratnagar Municipality, in 2005 can be taken as a glaring example. When internal terrorism is high the same ratio is covered by the Indian criminals of all types.

Since BSF built the border road, the border area has turned into the dwelling place for Indian criminals, who freely enter Nepal and create havoc by looting and killing. Therefore, Nepalis don't want to live near the border areas. The land thus becomes easy to encroach. Indian citizens, taking advantage of security forces, are involved in border encroachment, construction of houses in the No Man's Land and agricultural activities. 1

Indians steal domestic animals, smuggle timber and wild animals, rob personal property, and misbehave Nepali women. These criminals do get indirect support from the Indian officials.

Open border has been one of main causes of the destruction of forest, firewood, and the smuggling of natural resources such as timber, herbs, rare animal, and birds.

In India, in every five minutes a female is tortured, kidnapped, or raped. In every four minutes, a female is burnt to death. Such criminal activities have grown by 37 percent. However, the concerned authorities show apathy in these cases.2 Every year, 3 to 5 thousands lives are killed, including the known and unknown. Moreover, Indian criminals commit murder in India and throw the dead bodies into Nepal's territory.3

Many Indian frauds come to Nepal and cheat people with the temptation of changing brass into gold and a hundred rupee note into thousand and much more. Fake Indian doctors, Indian teachers with fake certificates, the jyotishis (fortune tellers) cheat simple and ordinary honest Nepali every day.

Nepali youth with the temptation of sending them to America are cheated and looted.4 Indian on the name of films, trickster, conjuror, fortuneteller and saints frequently cheat Nepali. Fake Indian Finance Companies5 cheat people. Indians engaging in the collection of waste materials promote theft.

Smuggling of drugs, weapons, counterfeit currency, trafficking of children and women are rampant. Indian smugglers are more equipped and stronger than police force. Thus, rascals, smugglers and criminals control over border areas.6

Because of open border, thousands of Nepalis young children are sold in different brothels and circuses of India for prostitution and child abuses.

Nepal has become the centre of large number of lower middle class Indian smugglers after 1990. They help produce Hemp in Nepal. Drug smuggling has deprived the character of some Nepalese Youths.

While importing and exporting goods from third countries, Nepali businessmen suffer from the frequent attack of Indian robbers. Black marketing also occurs in a higher level.7 Goods disappear without a slight break on the seal of the container or the keys. The theft is committed so aptly that by doing cutting welding and painting so that the goods owner can't claim insurance companies. Resultantly, Nepalis businessmen have to bear the loss of millions of rupees, and thus become bankrupt

It is estimated that 35, 00,000 Indians do job permanently, and 10 to 15 lakh seasonal labours enter every year. They are involved in the activities like smuggling, adulteration, production of low quality goods, theft, cheat, sale of contaminated foods and other useless materials.

Indians mix sand with cement, stones with rice, inedible materials with ripening fruits, sell venomous vegetables, curd, milk, and butter and put ISI mark on unqualitative hardware materials. Adulterate tobacco items and wine, poisonous mustard oil, causing jaundice, goitre, and effects on kidney and lungs.8 The unequal treaty of June 10, 1990 between India and Nepal allowed Indians vehicles to come to Nepal freely, whereas restricted Nepali vehicles, and thus resulting black marketing. Supplies of low quality goods including medicines, pesticides fertilizer have caused great harm to agricultural products. Thus, people's lives are at high risk because of adulteration.

The rejected venomous oil, mixed with agrimona causing dropsy in India was allowed to sell in Nepal. Similarly Paper Money / Cash Smuggling and Counterfeit Currency in Nepal are common business by Indians. They print and sale the fake note of hard foreign currency.9 Nepal has become secured place for the smugglers to label and export Indian banned products into third countries. India has more than 100,000 institutions from primary to university level to make fake academic certificates. More than 100 people enter Nepal every day illegally for those fake actions.10

India produces illegal weapons and exports in Nepal easily.11 Maoist could flourish due to this reason. The smuggler, supply home made and sophisticated arms, explosives as well.12

Some of the hired hoodlums, especially from Bihar and Utter Pradesh of India, make frequent explosion in Nepal.13 They bomb14/ capture booths in the general elections and damage public properties in time of bandh, strike or strife.

Therefore, Nepal prefers settlement on border problems as was done with China. As in accordance with the agreement, similar treaty can be made with India. India even does not like to talk about this issue.

2.Emcroachments In one way or other, the problem of border encroachment lies on almost all the places that are linked with India. However, so far the encroachments are noted in 85 places in 21 districts.

The Indian side has uninterruptedly conducted the activities like moving or breaking the pillars, smashing, ruining, transgressing and encroaching in settlements.

Border pillar is the guard of national integrity, evidence of frontier. If the inanimate evidence based on truth is destroyed by deceitful living being, there enters injustice, immorality, wrong principle of the primitive age that "might is right". This theory goes against and has been used against the meaning of the words like individual freedom, human right, democracy, liberalism, globalisation, liberty and so on.

Border pillars are constructed in the presence of both countries but are destroyed unilaterally and secretly. Rather, rivers change their courses occasionally and create problems, but pillars are the signs that are free from all these troubles. No change of such signs could be made unilaterally.

Besides, encroachments of the No-Man's Land by the Indian side have been intensified in different places these days. The Indian armed police involve to removing the concrete structures built in the No-Man's Land. The border has been encroached through tacit understanding between the Indian officials and police personnel. The civil officials have also provided security to them. The Indian Government has built a consulate and a customs office in the No Man's Land. India erects overnight artificial pillars, bent on creating the third No-Man's Land in several places inside Nepal. One who goes there for study may find himself in confusion.

Such incidents occur more in the remote places of which the common people remain uniformed. Signs erase when no news comes for years. This is such a burning example of India's vile tendency. The border pillars are moved, removed, changed, and uprooted. Many pillars are destroyed without leaving any traces of them15 e.g. Indians have relocated the border pillars 3.5 km north of the Indian Territory into Nepal at Susta. The Indian border security forces also remove the border pillar No. 33 from the Sirsiya. The joint team has already met 25 times� but the encroachments remain as it is.

A decision made on July 6� 1966 to avert border encroachment by making settlement free zone up to three kilometer on both sides of the border, India is ignoring. If the things as they stand now continue to exist� there will be no meaning of erecting and updating border pillars in the days to come.

3.Water Loggings

The large and long rivers like Koshi, Gandaki, Karnali, Mahakali, which come from the Himalayans, are logged by the central government of India and protects its property, people, land, and settlements in its territory by making afflux bund from the both corners of river. Because of the afflux bund constructed without consulting Nepal on the Indian side, Nepalis areas are water logged and flooded. Millions of property is ravaged. If India does not construct afflux bunds, the water can flow freely in natural form and Nepal does not have to become flood-affected area.

The second types of rivers emerging from the Mahabharat Mountains of Nepal enter India passing through the Terai region of Nepal piercing Chure hills are dammed by the state governments of India. They tamed for irrigation by constructing dams near the border of Nepal on the side of India.

The third types of rivers originating from the Chure hills having sufficient water during monsoon are taped by the local /district committee, Gaun Panchayast, consumers of India. This has assisted in swamping Nepal and irrigating India.

The wave of the river not only erodes the both edges of the river but also floods and swamps Nepali lands. The river erosion, for example, the dam of Bagmati alone affects 37 VDC/Municipalities. So are the hundred of cases in the southern bordering areas.

Water logging turns all the settlement areas and agricultural lands into sandy bank. People are forced to lead a life of refugee, losing their homes and villages. Many people and domestic animals die, and food grains become useless. Because of the water loggings approximately parallel to the borders, the river's water turns into pool and the pool further erodes Nepali land. The river ascends more and more, and that area becomes swamped. Thousands of hectares of crops are under water. It becomes difficult to cross the river. It also swamps houses and farming lands. The Nepalis people living in the border area spend miserable life during monsoon.

4.Greater Nepal The Nepali territory prior to the Sugauli Treaty (called the border problem of greater Nepal) had to be returned to Nepal. Because of the Sugauli Treaty of 1815/16, Nepal had to condense its larger territory to a smaller one. It was extended up to Tista River on the East, to Kangara across Sutlej River in the west, to the confluence of Ganga and Jumuna River in the south, touching the present day Bangladesh in the east.

The area of the Bishal Nepal is reduced from 2, 04,917 to 1, 47,141 square kilometer. India yet has to return 57,776 sq. km. to Nepal after 1950 treaty of friendship.

Nepal contributed a lot in the World Wars to make the English an empire. However, the British constantly betrayed Nepali people. They sliced a greater part of Nepal and annexed it in India. They also insincerely and treacherously departed without returning Nepali land to Nepal. The Sugauli Treaty of the time of the British is the only base for determining border which the 1950 treaties with India and Britain cancels all prior agreements including Sugauly Treaty. It means Nepal has right to occupy all areas before Sugauli treaty. It is not a begging but a legal right, if an understanding is made between the three countries, the real Nepal before Sugauli Treaty, is the real Nepal. As soon India knew the practices of Four Finger Theory.16, it absorbed Sikkim against the norms and values of treaty, agreement, Act, morality and good neighborhood.

Hence, it is necessary to reanalyze and interpret the Sugauli Treaty of 1815 ratified in 1816 and 1950's Amity Treaty to get lost territory back from the grip of India.

India as in the case of Kalapani to these days absorbed the Bagdogra – Galgalia lying between Nepal and Bangladesh by deploying its troop, fearing that Nepal will take back.

Nepali Congress Government rejected Ghising's proposal of greater Gurkha Empire, instead, Nepal's Counselor General in Kolkotta conveyed statement to West Bengal's Government.17

Land has been kept haughtily by India as done by Iraq to the case of Kuwait calling it its 19th state. One needs to analyse the history of Nepal and India and the treaties and understandings held between the two countries to understand how the above- mentioned land absorbed by India belongs to Nepal.

Nepal has abundant historical evidences to claim greater Nepal. For instance, in 1959, Mr. Nehru, the former Prime Minister of India, paid his visit to Nepal and agreed to amend trade treaty of 1950. He also agreed to remove Indian check post from Nepal. Nehru quotes, "Dehradun, Kumau and Nainital, Simla are the territories of Nepal which were once captured by the British." Author E.C. Kojl in "Brief Dictionary of Darjeeling" writes, "All these territories belonged to Nepal.18

British-India forced Nepal to sign the Sugauli Treaty, fearing that hill area war trained Nepali troops would expand their kingdom from the Brahmaputra River in the east to Pamir in the west. The objective of the Sugauli Treaty was to discourage Nepalis to make war so that they could not expand their kingdom the east of Tista and the west of Satlaj.

The Section 8 of the 1950 treaty has cancelled all the treaties, letters, and letter of agreement before the Sugauli Treaty. The dismissal of this treaty suggests that the territory before the Sugauli Treaty customarily belongs to Nepal.

The British signed the Sugauli Treaty evasively to prevent Nepal from galvanizing Sikkim, Assam and other states. The section 6 shows that the eastern border of Nepal is the Tista River before or after the agreement on the Sugauli Treaty. The Section 6 was included in the treaty to preserve Sikkim from the encroachment of Nepal.

The Titaliya Treaty between East India Company and Sikkim, the letters of treaty between British-India and Nepal regarding the return of the western Terai have justified that Darjeeling is inseparable area of Nepal. Similarly, the treaty held between East India Company and Bhutan on April 4, 1779 and the latest treaty of August 8, 1849 also justify that the territory from Mechi to Tisti lies in Nepal. Hence, Indian in accordance with the Article 1 (3) (C) of its constitution had not included this area including Darjeeling in India.

The 1947's Darjeeling Committee of the then Unified Indian Communist Party (ICP) had provided the Indian Constitutional Assembly with the decision of constituting independent 'Gorkhasthan Nation' by integrating Darjeeling, and Sikkim in Nepal. This document elucidates the article 1 and 8 of the above-mentioned 1950 Peace Treaty.

The Section 2 of the treaty India should have gradually returned the lost territory to Nepal. The section says, "The British Government declares that the whole low lands lying between Gorakhpur district and the Rapti River, and the whole low lands lying between the Kali and the Rapti river belonging to the Rajahs of Nepal prior to the Sugauli treaty and later to the British Government will be returned to be the sovereignty of the Royal of Nepal". India had made decision to return the territories to Nepal on November 1, 1860. The Sugauli Treaty was not ratified even after the ratification of the treaty with Sikkim. Without the ratification of the understandings and treaties held are naturally invalid. India's not giving validity to every treaty without ratification but the Sugawli Treaty is itself paradoxical.

The Section (8) of 1950 amity and peace treaty nullified the Sugauli Treaty. Therefore, Nepal has right over Darjeeling and other lost territories before the Sugauli Treaty whether there had been the Section 8 of 1950's treaty or the treaty itself.

The lost territories of Nepal were on lease as to the case of Britain, which as had taken Hongkong on lease with China. The phrase 'in perpetuity' was mentioned in the Hongkong Treaty signed between Britain and China. The term 'in perpetuity' is also included in the Sugauli Treaty. It gives the sense of the expiry of the treaty between two agreed countries after one hundred years.

Company Government had promised to pay yearly a tributes of two lakh rupees in return for the land taken on lease in accordance with the Section (4) of the Treaty. According to the section 9 of the same treaty, India in perpetuity gave the possession of its Praganna district (Now called Vijayapur district) to Nepal; India took back the territory, taken under the same provision.

The chief motive of signing treaty between Nepal and UK on October 30, 1950 A.D. was to give back the Nepali territory annexed into India. It is written on the preface that the Kathmandu Treaty of December 21, 1823 is not applicable because of the recent establishment of the two independent states India and Pakistan. Both Nepal and Britain signed new treaty and agreed on the following section.19

Therefore, the proposal of the restoration of greater Nepal is neither new nor unusual nor against international laws, treaties and agreements. In addition, the undecided question of greater Nepal is necessary to analyze and identify the absurdities created by open border.

The attitude issues

1. India wants to keep the immediate neighbouring countries under its influence and lordship to show that it is a powerful nation. It wants the neighbouring countries to vote on behalf of India in every international forum and organization, including UN. But Nepal wants to free itself from the lordship, suppression and neo-colonial domination of India, and to consolidate its sovereignty, and to restore position existed before the Sugauli Treaty. India also wants to keep Nepal under its military nexus and defence strategy. But Nepal denies remaining under that shade and strategy. Nepal wills to protect and formulate its own defence strategy.

2. Like Nepal, the present India is the unification of dozens of small free and independent kingdoms and principalities. The English people, having entered India founded a greater India by integrating those small kingdoms and principalities. In this sense, India is highly indebted to the British. Besides, the British-India, frequently waged war to absorb Nepal. However, they had to bear defeat in every war. India even after the abandonment of the British did not abdicate its colonial activities. Consequently, Goa, Daman, Dyuk, Hydrabad, Zammu, Kasmir and Sikkim were annexed in India. Fortunately, Bangladesh became an independent nation. Bhutan has been semi-colonized. Because of India's colonial trend, it views Nepal negatively.

3. India, born in 1947, quite younger to Nepal intends to treat Nepal as a big brother, treat Nepal as its handmaid, tame Nepal by imposing blockade unilaterally so on so forth. Indian behavior shows Nepal as the tributary state of India. Nepal totally denies and hates this bureaucratic attitude of India. India wants to sympathize Nepal, whereas Nepal wants to establish its right.

4. Nepal wants to keep India and China in equal distance, and to treat both the countries equally. India wants to keep an uneven distance with Nepal that is special proximity.

5. Bhutan, though, is an independent, sovereign and monarchical country; the people in there who demanded their democratic rights had to tolerate subjugation, oppression, exploitation and torture. When the Bhutanese Nepali found their lives in risk, they entered India for political refuge. However, India drove them towards Nepal in trucks. Autocracy Bhutan is getting protection from India. Because of strong stand of Nepal, it deployed force to quell it. In fact, Nepal has made better democratic exercise than Bhutan.20 India, by driving two lakh Bhutanese refuges (one on and one off the record) into Nepal, India did justice neither to Nepal nor to the Bhutanese refuges. Analysts view that Bhutan is next to Sikkim in the Indian grand design. Nepal denies such injustices.

6.India learned the art of colonization from Britain and it has been practicing the same old technique.

7. India transports cheap literature and films to Nepal that corrupt the habits of people, degrade morality and displace its own culture. Such things that come to Nepal freely not only degrade Nepali people but also transfer their wealth to India. These practices have been given encouragement by some Dorjians and protected by the Indian embassy.21

8. India wants to transfer its citizens to other SAARC countries in order to take relief from its over-population burden. It also wants to transport the homeless poor, illiterate and beggars to its neighboring nations. When there is no place to transfer Indian population, India puts electric barbed wire fence in its borders, and where there is still possibility of intrusion like in Nepal denies.

9.India suffering from colonial trend has got its Slave Mentality wants to impose upon Nepal. Because of such colonial trend, Nepal does not have back its lost territory from its grip so far.

10. India usually dishonours the sovereignty of Nepal and imposes its decisions on Nepal. India decides unilaterally be a matter of blockade, the deployment of military force or armed police or the arrest of any special persons in Nepal, border disputes, water loggings, barrages and dams construction can be taken as examples.

11. India, taking the advantage of sincere behaviour of Nepalis, misbehaves frequently. However, Nepali always views India as fellow nation.

12. Nepal Government gave some land on lease to India to construct Koshi Barrage at Sunsari district. But India did not return it even after the decades of expiry of lease date. Neither India closed the project office, nor did it return the land. Neither had it signed any agreement, nor did it get the project renewed.

13. India built the Koshi, Gandaki, Mahakali Barrages only for its benefit. If the dams had been constructed inside foothills of Nepal sufficient electricity would have been produced. Moreover, the arable land of the Terai belt of Nepal would have been irrigated and Nepal would have controlled the main grid.

14. Because if its ill-will attitude only Indian encroach Nepali territory. It is one of the harassing factors to Nepal. While people were protesting against the encroachment of India by the bank of Mahakali River in the west, Indian surveyors erected border pillars in Bhadrapur Municipality in the east to harass. Thus, unlike China, India has not shown gentleness and positive attitude to its neighbouring countries. Though the Central government may not be involved directly in activities such as disappearing border pillar, encroachment of territories, inundation, water logging, and many other offences, but it never takes any effective step to stop these activities.

15.Nepal wanted to implement the system of work permit to its citizen India went against of that.22

16.The Bhutanese democratic leader Rongthong Kinley Dorjee, relating to Bhutanese refugees in Nepal, reached Delhi to make political compromise under the mediation of India. Meanwhile, the India Government apprehended and put him to jail against the norm of democracy and human rights dishonestly. While terrorist declared Maoists were mediated and asked them to treat as democratic political forces. Weaker should tolerate the injustices? Nepalis have to bear India's domination because it is smaller in size and weaker in power.

17. Mechi and Mahakali people do not have place even for their last rites and for their pilgrimage. India has created turmoil all around borders. Every Nepali should be ready to dedicate their lives to prevent Nepal from the encroachment of India. Thus, India has hurt the self-respect of Nepali people.

The issue of Interferences

1.Continuous Interference

Nepal has been subjected to the incessant interference of India right after the 1950's amity treaty between these two countries. It will be impossible for Nepalis people to have their economic and social prosperity, make their own plans and decisions themselves by preserving their sovereignty.

1.India had already blocked the border for two times in the past. A political change was imposed into Nepal. The agreement made on the 10th June of 1990, interim government grabs economic, employment powers. An assault on Chinese technician in 1998, and the Baneshwor episode illustrate the direct interferences of India in Nepal.

2. Nepal intends to establish its own distinct identity by thriving national integrity and prosperity. On the contrary, India wants to assimilate Nepal in its rituals and culture. In this way, it puts many obstacles to deprive Nepal from being united.

3. Nepal wants to prosper its democratic culture. But India remains remission to it. That democratic system of India is to keep Nepal under its grip. For India, Bhutan is a democratic country having human rights and freedom of press (where no private press is r registered) while Nepal, Bangladesh and Pakistan has not, because India says so.

4. Nepal believes that the responsibility of a country with seaport facility is to provide landlocked country with easy access to the nearest seacoast. Unfortunately, India stands against it.

5. Nepal wants to trade the needed arms and ammunitions as other miscellaneous objects. But India expresses repugnance against this strategy.

6. Nepal is the country having various castes, complexions, religions and cultures. The amalgamation of all has constructed the Nepali nationality under the aegis of crown. Nepal is happy under its own condition but India is trying to give rise of communal tension by instigating the people of different regions and ethnic groups.

7.India shows its domineering behaviour to all its immediate neighbouring countries. For instance, during the informal visit of the Chief of Indian Army Shree Bipinchandra Joshi to Bangladesh, two aircrafts of Indian army had illegally and forcibly entered in the Lal Munighat area of Bangladesh.23 Likewise, Indian army had also forcibly entered in Sri Lanka and Maldives, and not to mention about Sikkim.

2.Political game plan (Interference):

1. RAW has taken its roots in Nepal by taking advantage of open border. The activity of this organization can be seen in Nepali politics and administration. Nepal's political leaders think that they cannot reach power without the support the RAW. Because of open border, Indians freely enter Nepal and acquire citizenship. This situation will result in minority of Nepali people in near future. While Sitaram Yachury/other Indian nationals were welcome as the head of the nation in Nepal's decade old non-elected parliament in April 2006, at the same time the so-called SPA had prohibited the MPs of the same category to inter the parliament because India said so. So was done by Mr.Chandra Shekhar and Swami Subrmandyam in the 1990 political change.

2. India citizens in some cases should take prior permission to move from one state to another. However, Indian police and army men in uniform and armaments forcibly enter Nepal, violating the norms of a sovereign nation.

3.Bullying and harassing are being done everywhere. The buffalo entering into the pond by breaking the peace of freely swimming frogs does not realize how risky it is for them to preserve their lives from its intrusion. Does the buffalo know how many frogs are trapped, and crushed? Whenever the frogs raise their voices for their fundamental rights and security at their disposal," might is right" principle will be applied against them.

4. On 1976, Nepal proposed to declare it as the peace zone nation having seven responsibilities and approving by 116 countries of the world, India's disapproval till now signifies that India does not want to free Nepal from its defence policy. Nepal is under total influence of India after the restoration of multi party democracy. The more a country has influence of another country, the further its basic right, independence and democracy wane.

5.India intends a conspiracy to keep Nepal under its control in terms of trade and military influence.24

3.Interference on Economics

1. Nepal takes trade and transit as two different entities. Transit is a fundamental right of Nepal, whereas trade depends on bilateral understanding. When India denied agreeing on two treaties, Nepal decided to sign only the transit treaty. Again, after seven years in 2001 and 2006, Nepal was forced to merge the two different treaties into one. It also forced Nepal to include the issues of defence and water-resource unnecessarily.

2.By every means, India wants to solely establish its monopoly of its low quality products in Nepali market. Indians also prevent Nepali products from entering India, thus making always trade deficit. On the contrary, Nepal desires to select the quality products from world market freely. Nepal denies becoming the part of India's self-vested protection strategy. Nepal aims to extend its trade freely all over the world. Nepal wants to diversify its trade in full-fledged. Nepal wants to practice its trade as the Most Favoured Nation (MFN). Nepal wants a complete abolishment of Indian monopoly

3. Being a landlocked country, Nepal wants to freely use the land route up to the seacoast, wills to make the use of Nepal railway, sea route and roadway according to the international law. It also intends to make the use of alternative way. Nepal takes transit and transportation as its right, whereas India as its blessing.

4. Penetration of Indian citizenin Nepal is very high. For them Nepal is like going to Honkong or USA. India wants to freely thrust its millions low level population into Nepal. Further, it intends to encumber Nepal. The amendments were made on foreign employment policy, Citizenship Act and Labour Act on Indian pressure. This tendency ultimately serves to open avenue in order to send its citizens to Nepal. In 1961 A.D., 3, 24,159 Indian dwelt25 in Nepal. After twenty years, in 1980, the population reached to 38,00,000 (as per P.V. Narsingh Rao). Among them, 23, 87,973 have already received the Nepali citizenship.26 In that condition, Indians will occupy majority in the parliament if Nepal could not be alert. Nepal has foiled non-Nepalis from purchasing fixed property. If Nepal concedes on this issue, whole of hills of Nepal will turn into a Summer Palace for rich Indians, politicians and industrialists within 20 years from now. As a result, Nepalis will be displaced in their own home country. India's strategy to keep Nepal always under destitution has resulted from its long-term vision.

5.If trade diversification is a one leg for a sovereign country, its other leg will be the internal economic and political freedom. Hence, Nepal feels the main cause for Nepal's underdevelopment ness is India

6.When Nepal starts some projects to be done through global tenders India objects (e.g. Birganj dry port, Mahendra High way) resulting delays for a decade. And spoiling relationship with other countries.27Smuggling and black market of India has been great hindrance for the economic prosperity of Nepal.

4.Interference on Natural resources

1. Nepal has the largest water-resource in Asia and second largest in the world. Nepal takes more than 6000 rivers as a reliable and continuous source for its future generations. Nepal wants to possess this resource permanently as its treasure. India wants to appropriate this resource into its possession before Nepal becomes able to produce, utilize and sell it. India's main reason of falling an evil eye on Nepal's defence is its water resource. Nepal wants to preserve its water resource from any possible harm.

After 50 years from now India's problem of energy and foodstuff will heighten. India has to increase its food grain capacity from 1633 hundred thousand tons to 3750 hundred thousand tons. For this purpose, irrigation is necessary. Out of 1333 hundred hectare land, only 862 hundred thousand land around the Ganges River is possible for irrigation. Only Nepal's water resource can fulfil the need. And Nepal will agree only if India becomes ready to buy water and electricity.28

Conclusion

1.Smashing and grabbing

1. Transit Facilities that a land locked country should get is limited. herefore, Nepal has undergone a complex situation both in industry and business sectors. If it gets facilities as per the international norms, Nepali trade/industry will boost up. India should not try to make Nepal dependent on India by imposing conditions on Nepal. Albania is also surviving like other nations even without keeping relations with rest of the world. Israel is a small country, which has been involved in war for 200 years and is surrounded by enemies on all sides. However, it has been successful in living with dignity. Maldives does not promote tourism but still it has found a way to survive.29 Japan has developed tremendously without having natural resources and fertile land. Why cannot Nepal be a prosperous country in the world?

2. It has become easy to import Indian goods in Nepal by evading custom tax30 from several custom points in all the places of border areas.

3. Telling a lie is a crime. Creating havoc in the economic life of Nepali people, keeping such clumsy attitude and telling one lie after another doesn't suit to a large and prosperous nation like India.

4. Nepal has to be free from economic trap of India by adopting most favored trade policy; using Chitgaon, Honkong and Karachi seaports through connecting underground road to Bangladesh and Tibet railroad and supplying cheap hydroelectricity to it; making Chitgaoun seaport simple and effective.

5.India is a Hindrance in the growth of Nepal's Economy. Because of India Kankai high dam, Karnali hydro project, Sikta project, Arun three, West Seti, Budhi Gandaki projects were failed. Had these projects been completed, there would have been no shortage of electricity for two decades, and the economic standard would have been doubled.

6. Nepali industries and trade are ruined because of India's monopoly market. Nepalis are deprived of consuming quality products at moderate price and of dealing with competitive business in the world market, resulting in the poverty of Nepal. Thus, Nepal can never progress unless an open economy is established and dependency on India is avoided. If the price of goods goes down in Nepali market, Indians, like ants, carry goods on bicycle/heads and make shortage in Nepal, if the price goes high, becomes vice versa; thus failing Nepali industry and commerce.

2.Weaknesses of Nepal: the Dorjian attitudes:

Nepali leaders suffer from poor mentality that they cannot have access to the power if they disappoint India. They are dumfounded and tacit even by witnessing the interference of India over Nepali economy, nationality and territory as if a python is swallowing its prey.

His Majesty's Government of Nepal never shows its firm stand for the preservations of nation and has failed to study deeply border area and analyze the problems resulted from it.

Nowadays, political parties give the subjective interpretation of the nationality, not taking it from objective point of view. Their vested interest is higher than the national ones. Fractions in parties, political instability, political liquidity and conflicts are due to Indian interests. The roles exposed in 1st April 1990 by S.K. Singh and on April 20, 2006 by Shyam Saran are the glaring example as intended by the South Block. Therefore, Nepali bureaucrats and political leaders must learn nationalism from Indians despite being bland followers of them.

Now, we must avoid geo-constraints proverb; impart knowledge to be a Patriotic Nepali learning nationalism from Indians that non-nationalistic be supposed uncivilized, rudeness and undemocratic characteristics. Open border System be discontinued; the encroachments be controlled; administrators be alert and dedicated to nation's interest; do always democratic practices; apply equal-distance & equal behavior policy to neighbors. Develop a Shade Free Development; avoid Indian Political Interests in the internal matters of Nepal; Pressurize to change Indian attitude; deal perfectly for the returnable territory and above all realize 'United we stand divided we fall'. Now, start telling untold stories to the remaining world. Let them share our troubles and gain sympathies as well.

Arrange to get Transit Facilities from different ports of India, Bangladesh, Pakistan and People's Republic of China. Conduct air-cargo services between Nepal's Bhadrapur to the border of Bangladesh/Chatgaun.

Nepal, the country of Buddha, must be turned into peace centre by the approval of India to the peace zone proposal of it, already accepted by 116 countries. India should have compulsorily compensated the flood-affected area of Nepal and stop for further detritions. RAW nullifies every scheme of Nepal that intends to raise economic growth, exploit natural resources and uplift lifestyles of Nepali people. But straight forwarders and honesty are beneficial for the development of our country. Nepal expects change in attitude of dividing Nepali into places, castes, languages, gender, religion and property by using every trick through 'RAW'. All Nepalese people too should unite in the matter of nationality.

Maoists take away 150 students

KATHMANDU, June 7 – Maoists forcibly took away 150 students from schools in Rame-chhaap to make them participate in rebel programs recently.

According to locals of Bhatauli, Pakarbas, Pinkhuri and Gagal villages, their wards were herded to the district headquarters Charikot, to attend a Maoist mass meeting scheduled for Tuesday. Earlier also, the Maoists had forcibly taken the same students for participation in their program in Kathmandu on Friday without the consent of parents.

"As soon as the students arrived from Kathmandu and began attending school, they were again taken away from the school itself," said a local.

Meanwhile, CPN-UML Dhanusha district, issuing a statement, accused the Maoists of violating the agreement with the political parties and the code of conduct.

"Extortion, torture and coercion are still rampant in the villages," said the release signed by CPN-UML district secretary, Yognarayan Yadav. In a recent case, the rebels asked Rs 25,000 from a potter Ram Ekbal Mandal of Hadbanda and beat him and his workers when he refused to pay. In Bardiya, Maoists freed seven persons from Maina-pokhari whom they had abducted three months ago on charges of working for security forces. However, Rambabu Regmi of Kalika, abducted along with the seven, is yet to be released.

Abducted people found dead in Rautahat

The dead bodies of two people, abducted by the Maoists six days ago, have been found at Inaruwa VDC, Rautahat Saturday morning.

Bodies of Sambhu Sahani and Shyam Sundar Sahani, sons of Congress District Working Committee member Jyogindra Sahani, were found buried near a river.

The Maoists, after bombing the house of Sahani had abducted the slain brothers from Basantapatti village development committee (VDC) of the district accusing them of trying to disrupt a Maoist meeting.

Reports quoted Superintendent of Police Keshav Adhikari as saying that the badly mutilated bodies were found buried at a local river bank.

The Maoists however, have claimed the Sahani brothers of being dacoits and that the villagers themselves had beaten the brothers to death.

Locals have strongly refuted the Maoists' claim of villagers doing the killings, pointing out that it was the rebels who did the brothers in.

Meanwhile, the Office of the United Nations High Commissioner for Human Rights in Nepal has begun an investigation into the incident.

Nepse continues downward trend; falls 13.76 points

The downward trend of Nepal Stock Exchange (Nepse) continued over the week as well due to the weak performance of commercial banks group.

The Nepse index, the only secondary market of the country, plunged by 13.76 points, which is one of the highest fall in the index in recent months.

The index reached 368.89 points on Thursday, the last day of the trading under a regular lot down from 382.65 points on Sunday, the opening day of the week.

The downward trend began last week, when the Nepse index dropped by 1.78 points after three weeks’ impressive growth, following the political development of the country.

A total of 1,307,521 units of shares valued at Rs 139,357,096 were traded through 1,413 transactions during the week. Last week, a total of 255,839 units of shares worth Rs 152,717,592 from 2,270 transactions were traded.

The weekly trading report shows that the index of the commercial banks group, which is the largest by volume at Nepse, plummeted 21.33 points to 418.91 points down from 440.24 points on Sunday.

Similarly, the insurance and the development banks groups also showed weak performance as their indices stood at 351.37 points and 278.86 points respectively on the closing day down from the opening of 351.94 points and 282.99 points respectively.

However, the trading and the finance groups maintained growth, reaching their indices at 148.11 points and 254.36 points respectively on the last day from 147.27 points and 253.59 points on the opening day.

The hotel group’s index also posted a growth and closed at 179.42 points, up from 147.27 points on Sunday.

However, the manufacturing and the other groups remained constant at 292.34 points and 363.69 points respectively throughout the week.

Of the total transactions during this week, the commercial banks group dominated the Nepse floor by capturing 75.85 percent of the total share trading.

The share of finance group comprised of 15.37 percent, while the insurance group followed it by 8.15 percent. The trading group was able to capture only 0.77 percent, while the development bank group had a mere 0.35 percent share in the overall trading. nepalnews.com pb May 28 06

‘Janasarkar 001’ mocks traffic rules

DOLAKHA, May 26 – A motorcycle that the Maoists had earlier seized from the District Development Committee (DDC) office is not only used openly by the rebels but has also been given a new registration.Omitting its real number (Ba-1-Ba 6583), a Maoist commander known as "Kiran", inscribed a new number — Janasarkar 001 – over the numberplate. Locals in the district headquarters, Charikot, are surprised seeing a motorcycle with this new type of number plate, which is often driven around by Kiran, well-known for his short temper and for behaving rudely with the locals. The Maoist changed the numberplate on Thursday.

Enthusiastic to ride in new vehicles, Kiran, used to drive a vehicle that was seized from the divisional road office earlier. Likewise, he drove an ambulance of a local hospital to ferry injured comrades during the Charikot clash around two years ago.

Several vehicles in Kabre VDC were destroyed due to his wrath when his party was an underground outfit. He also burnt down a vehicle of Ramechhap district health office.

When asked about use of the motorcycle that was seized from king-nominated DDC member Samsher Ghising some four months ago, he said it was used for party work.

The motorcycle was given the "first number" as it was the first vehicle to be registered with the "people's government", he said. Making a mockery of traffic rules, Kiran wears a "dhaka topi" instead of a helmet, which is mandatory. However, policemen at Satdobato check post remain mute spectators when he drives past.

Hindus protest in Nepal against official switch to secular state

KATHMANDU (AFP) – Religious activists have called a strike to protest against the government's decision to end Nepal's status as the world's last Hindu kingdom, police said.

Demonstrators blocked roads on Wednesday with burning tyres, closed shops and ransacked a newspaper van before torching its contents because it backed the new government's move to order Nepal's change to a secular state.

Police said Hindu groups planned to continue their protests at the border town of Birgunj 275 kilometres (170 miles) south of Kathmandu, with demonstrators travelling from the capital and neighbouring India.

"The activists have called for a general strike today and have begun obstructing the traffic by burning tyres," said the town's police chief Bir Bahadur Rana on Thursday.

He said the protests had been growing for several days with Wednesday's disturbances the largest so far with property including a dental hospital vandalised.

Nepal's government last week proclaimed that Nepal, whose population of 27 million is more than 80 percent Hindu, was now a secular state as part of an effort to remove powers from King Gyanendra.

He was forced to give up 14 months of absolute rule last month in the face of weeks of popular protests.

Gyanendra is seen by many of his countrymen as the reincarnation of Lord Vishnu, the Hindu protector, but has been condemned by rights groups and political opponents for his authoritarian style and crackdown on protests that left 19 dead in April.

Protestors vandalize Everest Nursing Home

A group of people vandalised the Everest Nursing Home at Baneshwor in the capital on Wednesday morning alleging that a patient died of ‘doctors’ negligence'.

he relatives of Tula Ram Gautam, who died while undergoing treatment at the Nursing Home, claimed that he died due to the negligence of the doctors and the staffers of the Nursing Home.

Late Gautam had been admitted to the Nursing Home at 4:30 a.m. this morning.

Over hundred people including his relatives vandalised the hospital. The protestors also burnt tyres on the road in front of the Nursing Home, chanted slogans and demanded action against the ‘guilty doctors’.

Traffic movement of Baneshwor and other parts has been disrupted due to the protest at the centre of the city.

The Nursing Home is referring patients to other hospitals due to the insecure environment. Police is providing security to the hospital. An eyewitness informed Nepalnews over telephone at 12:00 noon that a large number of people are still protesting outside the Nursing Home.

Three protestors were injured when police baton charged to control the mob.

A meeting is underway between the family members of Gautam and the Hospital administration at the District Administration Office to settle the dispute.

In similar incident, a mob vandalized Lumbini Zonal Hospital (LZH) and two dozen other private clinics and set ablaze an ambulance, alleging that a patient was reportedly killed due to the doctor's negligence.

According to local reports Maoists were actively engaged in the vandalism. 15 policemen and a doctor were injured in the incident.

The Kantipur daily quoted Saroj Thapa, a Maoist guerilla as saying that 20 of their men were deployed during the protest in Butwal. No family member of the deceased Sapkota was present during the protest.

Maoist continuing atrocities; bomb house of NC cadres

Maoists detonated bombs at the house of a Nepali Congress district committee member and chairman of Basantapatti village development committee Jogendra Sahani, at Basantapatti VDC-6 in Rautahat district and abducted his two sons.

Sahani's wife Ramkali Devi, who sustained serious injuries in the incident, was taken to India for treatment.

The rebels also badly beat up all five members of the family before abducting Jogendra's sons Shyam Sundar and Shambhu. Quoting Ramkali, police said the Maoists tied the two up and took them to unknown destination.

They accused him of spying against them. After the Maoists issued frequent threats against him, he had fled the village a couple of years ago and taken refuge at district headquarters Gaur.

Maoists also looted cash and goods from the house.

The Maoists, owning up the bombing, said it was action taken against Sahani as he tried to obstruct their program.

The incident came at a time when the government and rebels are preparing Code of Conduct to be implemented during the period of ceasefire and talks.

A day after arriving Kathmandu to prepare ground for 'summit level talks' between his party and Seven Party Alliance (SPA) government, spokesman of the CPN (Maoist), Krishna Bahadur Mahara, has alleged that the government is not serious towards negotiations.

"The have neither announced a full-fledged negotiation team nor responded to our code of conduct. It has created confusion," Mahara told Nepal F. M.—a private sector radio station based in Kathmandu—Monday morning.

Mahara said that the environment for talks was yet to be crated. He insisted that the government release all the Maoist detainees before the talks would resume. "A lot of political and practical things need to be done before talks could resume. The government doesn't look eager, serious or pro-active for negotiations," said Mahara. He, however, said his party was ready to sit for peace negotiations as soon as "environment for talks were created."

Responding to a query by Binod Dhungel, news editor of the Nepal F. M., Mahara said allegations of extortion, abduction and continuing recruitment in the Maoist army were unfounded. "We have been looking at such allegations very seriously. Domestic as well as foreign forces that want to spoil the environment of negotiations could be behind such allegations," said Mahara. Referring to allegations of extortion from industries based in Birgunj, he added that his party did not have a policy of raising forced donations. "Of course, we will collect voluntary donations," he added.

Mahara reiterated his party's demand that the existing constitution should be scrapped and the reinstated House of Representatives (HoR) be dissolved immediately. He said the basis of the reinstatement of the HoR was the constitution of 1990. "The country has moved far ahead. The 1990 constitution can't represent today's people's sentiments. So, the present constitution and parliament needed to be dissolved," he added.

The Maoist spokesman demanded that the government convene a grand political conference – which he said would be a supreme body and much powerful than the reinstated parliament. "Only then an environment for forming an interim government would be created," he said. He, however, said as an important partner of 'jana andolan' (people's movement), the Maoists were ready to help the government to move towards the constituent assembly.

"The crux of the matter is whether the SPA government understands us as yet another political party or a new regime and political force that had its own army," said Mahara.

Meanwhile, reports say Mahara arrived in Kathmandu Sunday to prepare for negotiations with the government and also to take part in a first public meeting being organized by his party in Kathmandu on June 2. Kantipur daily reported that Mahara arrived Kathmandu from the mid-western town of Nepalgunj aboard Buddha Air along with his two 'bodyguards.' Security officials stopped Mahara's body guards as they tried to board the aircraft along with their weapons. The team, however, agreed to leave behind their weapons after Home Minister Krishna Sitaula asked them to do so, the news report said.

Other members of the Maoist negotiation team, Dev Gurung and Dinanath Sharma, are also expected to arrive Kathmandu within the next two days, according to reports. nepalnews.com by May 22 06

Prachanda to surface in Kathmandu 2 June, other details

Kathmandu, 20 May: Maoist Chairman Prachanda will surface in Kathmandu 2 June.

Posters were posted on walls in the capital announcing he will surface at the Open Air Theatre at one in the afternoon that day.

Prachanda will appear in Kathmandu one day after the fifth anniversary of the Narayanhiti Royal palace massacre and when the seven party coalition (SPA) is working to bring Maoists into an interim government ahead of elections for a constituent assembly.

The election will not be fair, free and impartial because the SPA has already adopted a republican agenda by curbing the powers of the King and army ahead of the assembly proposed polls.

Governments in Nepal and the region are known have to manipulated polls to suit the agenda of ruling parties.

If free, fair and impartial elections are to be held for an assembly, it must be conducted by a neutral government.

Meanwhile, the NC central committee Saturday asked Maoists to stop extortions and forcible recruitment into their militia.

The committee asked the government led by the party to push talks with the Maoists to regularize a 12-point agreement.

The committee welcomed Thursday's parliamentary proclamation.

The NC committee accused Maoists of not honestly implementing the 12-point accord accusing Maoists of continuing extrotions and recruitment.

Industries on Birgunj have closed down after Maoists demanded more than Rs 100 million in extortion money.

Sher Bahadur Deuba was Saturday elected the parliamentary party leader. Challenger Bijaya Kumar Gachedar collected only13 votes to Deuba's 24.

Former prime minister Krishna Prasad Bhattarai, PL Singh and Deputy Speaker Chitralekha Yadav didn't cast their ballots.

Koirala calls Prachanda, urges to stop extortions

KATHMANDU, May 21 – Prime Minister Girija Prasad Koirala on Saturday urged Maoists Supremo Prachanda to halt extortion and intimidation against businesses.

According to a source, Koirala telephoned Prachanda in the afternoon and urged him to allow industries in Birgunj, including Dabar Nepal, to run smoothly. These industries remained closed for the second day and industrialists have issued a 48-hour ultimatum to the rebel's trade union to sit for dialogue threatening an indefinite closure.

In response to Koirala's call, according to the source, Prachanda said that he would issue internal circular to the party cadres after investigating if his cadres have extorted the industrialists.

Maoists continue extortion

Meanwhile Maoists' cadres have asked for donations under different titles in Narayangadh bazaar and adjoining areas lately.

According to local businessmen, "They come with different names of their sister organizations and ask for hefty sums under different heads, like for the expansion of their organization and to feed their guerrillas," said one businessman. "They come with the donation pad of ANFTU, their student wing and other organizations and threaten to take action if we don't give them the sums asked."

According to them, the Maoists fix the sums payable after asking about their income and business type. The businessmen, who have been terrorized by the forced donation drive, lamented that they could neither pay the huge sums nor reject the demands outright due to the impending danger that involved.

In another report from Butwal, Maoists awarded a contract for the sale of forest and river products and disused commodities after inviting a tender on their own.  Responding to the tender notice of the rebel's "joint revolutionary district council" were 13 persons. Prakash Gupta was selected as his offer of 10 million 1,119 rupees was the highest.

BIRGUNJ, May 20 – Dozens of industries located along the Birgunj-Pathlaiya corridor including Dabur Nepal have shut down their operations for indefinite period after they failed to cope with the recent rise in Maoists' extortion drive and intimidation.Dabur Nepal, Triveni Spinning Mills, Jagadamba Steel, Shiva Shakti Ghee Industry, Rajesh Metal and Narayani Rolling along with dozens of industries closed operations from Friday after the Maoist-affiliated All Nepal Trade Union Federation (ANTUF) intensified activities in their factory premises.

“Cadres of the federation enter the factory premises forcefully, organize mass meetings and even manhandle promoters and senior officials. Industries simply cannot continue operation in such a situation,” said Sushil Mittal, vice president of Birgunj Chambers of Commerce and Industry (BCCI).

Irked by the Maoist extortion drive and ANTUF pressure, BCCI have also issued a 48-hour ultimatum to the federation to come for talks to resolve problems.

“We will close down all the industries of the area for indefinite period if the federation did not respond to our call for talks within the ultimatum period,” Mittal stated.

According to a statistics, over 450 medium and large scale industries are based along the Birgunj-Pathlaiya corridor alone.

Senior General Manager of Dabur Nepal, S P Malhotra said that sudden closure has inflicted the industry a loss of millions of rupees. He elaborated that the leaders of the ANTUF had started to disturb industrial activities over the last few days. On Thursday, Central Secretary of the Federation, Rajen Timilsina forcefully entered Dabur factory premises and organized a mass meeting for four hours.

The federation cadres had forced the managers to shut down operations for the workers to attend in the mass meeting, in which the leaders demanded the management to make all its staff permanent jobholders. “We decided to shut down the factory till further notice, as federation leaders gathered in the factory premises organized a sit-in protest from the early morning today,” said Malhotra. Sources, meanwhile, said that the Maoists and the Federation, issuing separate letters, have asked Dabur Nepal to pay them Rs 100 million as 'tax'.

Likewise, Federation cadres on Thursday had organized mass meeting at Triveni Spinning, misbehaved with officials of its two recruitment agencies forcing them to walk for five kilometers.

Addressing the mass meeting, the leaders had said that they would take tough 'physical actions' against promoters if they did not fulfill the federation's 22-point demands.

The 22-point demand letter of the federation urges the employers to fix minimum salary at Rs 3,000, provide Rs 1,000 each as dearness allowance and rental allowance and provide medical and insurance coverage at workplace.

Annual leave of 55 days, issuance of permanent appointment letter after completion of 180 days of work and provision of pensions to workers in case of lay off are also its major demands. It has also been forcing the employers to recruit the Maoist cadres.

Industrialists, however, stated that they cannot fulfill all the demands of the ANTUF and had invited its leaders for negotiation to settle the matter. The federation cadres, however, have stated that they take actions if the employers paid no heed to their demands.

Amid huge ‘extortion threat’ by a trade union wing of the CPN (Maoist, Dabur Nepal Pvt. Ltd. (DNPL)—one of the largest joint venture companies in the country—has closed down its manufacturing unit at Rampur Tokani of Bara district in southern Nepal.

Dabur Nepal officials have not said anything regarding the reason behind closure of its factory but reports said Dabur Nepal officials decided to close down their factory after senior pro-Maoist trade union leaders visited the factory, threatened the DNPL managers and placed a number of demands including a “donation” worth millions of rupees.

Talking to reporters in southern town of Birgunj on Friday, president of Birgunj Chamber of Commerce and Industry, Bijay Sarawagi, said the Maoist-affiliated All Nepal Trade Union Federation had given ultimatum to local industries to fulfill their demands by Sunday. But they started threatening the industrial units since early this week, manhandled managers and spread terror.

“We can’t pay taxes both to the government and Maoists. The new government—that is in direct touch with the Maoists—must take immediate measures to resolve this problem,” he added.

Meanwhile, industry sources in Kathmandu said they have invited Maoist leadership for talks within the next 48 hours. “If they don’t stop their extortion and threats by then, all the factories in Bara and Parsa districts will be closed down indefinitely,” a leading industrialist told Nepalnews over phone.

Businessmen and entrepreneurs have complained that Maoists are continuing their `extortion' drive despite the ceasefire and repeated requests from the government not to do so.

Reports quoted chairman of Regional Hotel Association, Pokhara, Laxmi Bahadur Bhattarai, as saying that the Maoists have been demanding money from entrepreneurs but they are in no condition to pay a penny. Bhattarai also said that they had apprised the Maoist leadership about the issue.

Chairman of Pokhara Chamber of Commerce and Industries, Rajendra Kumar Lalchan, said the Maoists are demanding cash and even goods from shops and other business houses in Pokhara Sub-metropolitan City area.

They have demanded a motorcycle each from all motorcycle showrooms in Pokhara and cloths from local cloth stores, he said.

Kaski district secretary of CPN (Maoist), Karan, said the party has not forced anyone to 'donate' cash or kind for the party. "We have maintained much restraint on the matter of donation collection," he said.

Kathmandu, 19 April: “The practice and development of journalism during the fifteen years after the restoration of democracy in Nepal has been disappointing”, says journalist Rewati Raman Subedi in an interview to Ruprekha weekly.

“Journalists of Nepal are misusing the term ‘journalism’ as they have crossed the limit of press freedom. Every organization has its definite boundary and if someone tries to cross that boundary, it is not freedom, it is anarchy.”

“Only political organization holds the right to question the constitution but when it comes to Nepal, journalists are attacking the constitution openly. Anarchism is being promoted in the name press freedom.”

“When it comes to blaming the constitution and King for bringing Nepal into this condition, both constitution and the King is blameless as the political parties did not intend to revise the constitution when they were the ruling party and governing the nation. The appeal of seven parties for changing the constitution at this period of time is absurd.”

Kathmandu , 18 May: Senior advocate Ganesh Raj Sharma said a political proclamation being made by the House of Representatives is illegal, Shamakaleen reports.

In an interview to BBC Nepali Service yesterday, constitution expert Sharma said when there was no revolution to throw away the constitution, he suggested not to make any declaration against the spirit of the constitution.

He argued parliament functions under law. He warned the country will face a future crisis is a wrong convention is established to bypass the constitution.

He said: "If political decisions are going to be taken through the use of force, another power tomorrow can overturn the decision."

Sharma asked those calling for the rule of law to govern through the rule of law. He suggested amendments in the constitution instead of announcing a proclamation from the House of Representatives.

He said the rule of law means to move within the parameters of the constitution.

He said the leadership of the seven parties should be declared all-powerful if the constitution is to be bypassed.

'This House of Representatives is not the supreme body and it cannot do anything as it likes," The Himalayan Times quoted Attorney General Yagya Murti Banjade as saying.

The Attorney General is the government's chief legal advisor.

The newspaper reported Thursday: "He also questioned the legitimacy of the much-expected declaration of the House. "How can the declaration get legitimacy?'"

"People will not accept autocracy from any quarter, Banjade said. "Unless the declaration is incorporated into the Constitution through amendment, how can we believe that it is part of the Constitution?" he asked the newspaper reported.

Advocate Bhimarjun Acharya said that such a declaration of supremacy of the parliament is sheer violation of the rule of law.

"This is nothing but undermining the rule of law and lacking in legitimacy," he said, adding that it amounted to nothing different from the "King's autocracy."

KATHMANDU, May 15 – Maoists in Simikot, the district headquarters of Humla, extorted "donations" from 35 Indian pilgrims who were returning from Manasarobar in Tibet on Sunday. According to victims they were forced to pay a total of Rs 33,000 to a group of Maoists led by vice-chief of people's army, Surbir Ari.Meanwhile, in another incident of extortion, the rebels on Sunday demanded 20 days' salary as "donation" from teachers at Bikash Higher Secondary School at Lamjung district headquarters, according to a statement from Royal Nepalese Army headquarters. Similarly, rebels last Wednesday collected food items from locals at Mangtewa area of Sankhuwasabha district and manhandled Maheshwori Secondary School's teachers at Bala VDC, the RNA statement said.

In clear violation of a ceasefire and their 12-point agreement with seven political parties, Maoist cadres on Friday night beat to death a former Maoist cadre, Prem Bahadur Thokar, 40, a resident of Jagatpur VDC-6, Nayabasti.

According to local villagers, around six Maoists beat up Thokar at Krishna Chowk at around 5:30 pm and threw his body in a field near Thokar’s house before fleeing.

Locals claimed that slain Thokar had no links with the rebel outfit recently although he was involved in their activities earlier.

According to reports, during their mass meeting at ward-4, Krishna Chowk few days ago, the Maoists had warned that they were taking action against those "defaming their party". At that time, Thokar, along with four others, were threatened by the Maoists that action would be taken against them.

Condemning the incident, different district-based human rights organisations urged the Maoists not to repeat such incidents.

Meanwhile, in another incident, two persons including a minor were injured when a Maoist-left socket bomb went off at Manpang-8 in Tanahun district, Saturday.

Sanjeev Kumal, 8, and 16-year-old Som Bahadur Thapa, were those injured. "As soon as he (Sanjeev) gave that object to me, it exploded with a loud bang on my hand," reports quoted Thapa as saying. According to locals, a group of Maoists had come there in the morning.

Meanwhile, in yet another incident the Maoist-obstructed postal service in the mid-western region is yet to resume even after truce.

This has badly affected people in the remote districts. The area post offices in Dailekh, Jajarkot and Surkhet districts have completely closed down, report quoted Dinanath Lamsal, chief of the Regional Postal Service Directorate at Surkhet. nepalnews.com pb May 14 06

EXPLAINING MAOIST STRATEGY: IT'S ALL IN THE SCRIPT

Even as I write, events in Nepal unfold as if a Broadway play – nary a miscue from the script passed out months ago in the Nepalese media.

Having declared a "ceasefire inside the Kathmandu Valley," thus to gain the media "spin" that would necessarily come from "peaceful protestors" being "attacked," the Maoists proceeded elsewhere in the country to attack positions. The Butwal attack is only the most recent example.

Open use of violence "outside" the urban centers has been accompanied by orchestrated rioting "inside." That the foreign media (with the help of the anti-government sectors in the Nepali media) persist in calling such "peaceful protest" only demonstrates how thoroughly detached they are from the reality of the people's war approach.

From the Maoist Playbook

To outline the Maoist strategy for those who were not present at the auditions for parts:

● Overload the security forces "inside" while attacking with main forces "outside." Claim to be only supporting "peaceful" forces for change.

● Use government troop deployments to advantage. If the security forces must move more men inside, flow into the vacuums left behind. If they move outside, send urban partisans inside.

● Exploit every death and claim that any setback (e.g. failure to overthrow the government) proves that only the violent way is left to install "absolute democracy."

● Break the RNA at all costs. RNA is the one real obstacle remaining in the quest for power. So caught up is the SPA in its short-term effort to remain relevant that it is oblivious to long-term peril. SPA can be counted upon to mindlessly perform on cue.

● Move now to exploit the opening provided by Indian perfidy. New Delhi senses an opportunity to at long last create of Nepal a dependency that will do as it is told.

From the Maoist perspective, they have adopted a "win/win" course of action: no matter what actually happens, they will benefit.

By declaring a "ceasefire outside Kathmandu Valley," they seal off the battle area, declaring that it will be a fight between rival bodies of manpower. They feel that the SPA manpower on the streets can overwhelm whatever the police and APF (the backup) can put on the playing field.

When the authorities make mistakes, which ultimately they must if SPAM plans go off as scripted, the government is again "human rights abusers" — and the howls can already be heard from the usual suspects. Some elements of the Nepali media appear to be working deliberately to fan the anti-government flames.

Further, the violence allows the Maoists to claim they at least gave "peace" a chance.

The dream scenario, from the SPAM perspective, is to replay 1990, with masses rushing across the open boulevard leading to the main palace gate, the troops forced to open fire, bodies filmed by international media and beamed worldwide, India declaring it can no longer stand by "as democracy is crushed."

Role of India

India's role remains to be untangled, but no one who was in Sri Lanka in July 1987 – as I was – can overlook the startling similarities. The Indian invasion, conveniently disguised as the IPKF (Indian Peace Keeping Force), was but the culmination of half a decade of support for Tamil insurgents/terrorists that New Delhi thought it could "manage."

Then, as now, the shape of the international arena played a significant role. India, many have forgotten, had sided with the Evil Empire. There were some 6-7,000 Soviet advisors in the country. It was the first country outside the Warsaw Pact to receive the MIG-29 fighter, the first (and only) ever to be rented a nuclear submarine.

Beyond all else, in a relationship only now emerging from files of the KGB spirited out of the country prior to the resumption of the authoritarianism, the government of Indira Gandhi allowed itself to be fed Soviet disinformation that convinced it Sri Lanka was a threat.

Alleged "special intelligence" provided by Moscow purported to prove Colombo was on the verge of granting Washington basing and spying facilities, India became involved with the Tamil insurgents, eventually training, arming, and basing them. When an initial massing of forces to invade in early 1984 was warned off by the Reagan administration, Delhi simply waited for a more propitious moment. This came in July 1987, as the Sri Lankans moved to crush the trapped insurgents in Jaffna.

What that moment shares with the present is the astonishingly bad "intelligence" that drove Indian policymaking, as well as the claim that "foreign hands" support the monarch. Putting the word in quotation marks only highlights what Indian field commanders realized within days of landing in Jaffna – there was little they had been given in their briefing packets that was accurate.

That India's Research and Analysis Wing (RAW) had produced "analysis" every bit as flawed as any in the annals of intelligence debacles has since been recognized by no less than India's imperious Proconsul at the time, J.N. Dixit (now deceased) – though he continued to claim, even in his last writings, that India's information on America's intentions was completely reliable.

That India had completely botched its assessments of Sri Lankan ground realities would not surprise anyone who has followed what has emerged as the dominant government position in the present Nepali crisis. Indeed, Indian participants in panels held in Washington, DC, such as S.D. Muni, have distinguished themselves principally in what can only be characterized as willful ignorance of SPAM pronouncements and motives.

To cite but the most egregious example, the Indians continue to claim SPAM is willing to negotiate for itself a role in a parliamentary framework headed by a constitutional monarchy, even as the Maoists give press conferences claiming they will try the monarch in a people's court.

There do seem to be analysts who have correctly identified the astonishingly strategic myopia involved in destabilizing Nepal further even as India itself grapples with its own growing Maoist challenge. In his recent "India, Maoism and Nepal," former Finance Minister Madhukar S.J.B. Rana hit the nail squarely on the head when he wrote, "India is playing a dangerous game of pure real politic where it seeks to intervene in Nepal militarily by using the Maoist [as published] as proxy under the unbelievable propaganda 'to secure peace and democracy for the Nepalese people and to arrest the impending refugee inflow into its own territory'."

Change a word here and there, and the logic is identical to the debacle that became IPKF. It is further noteworthy that in the three bloody years that followed July 1987, IPKF acquitted itself well in "India's Vietnam" (as it was called by the press), even as Indian policymakers sought to cast blame for the blunder on anyone and everyone except themselves. (The most ludicrous position, of course, was the very one the Maoists advance now: it is all the fault of American imperialism.)

Where to From Here?

As irony would have it, it is the growing amicability of India and the US which has served as the strategic cover for New Delhi to bring Kathmandu to heel. Nepali sources have become increasingly blunt (and strident) in the same manner as the Sri Lankans all those years ago, as the Indian ties to Nepali violence become more clear.

One does not have to engage in plot mongering to posit that India is making a major policy error in steering its present course. Neither does one have to cast aspersions to point out the obvious: the SPA portion of SPAM has been willing to play the quisling for momentary political gain.

For it will be momentary, come what may. Let us suppose that the present government collapsed tomorrow. Where would that leave SPA? With two useless pieces of paper and a worthless sheath of promises.

What is tragic is that very little would seem to separate the sides at the moment save profound mistrust. The king agrees that parliamentary democracy should be restored with a constitutional monarch. The Maoists claim they will accept a democratic republic of whatever sort is decided by a constitutional convention. SPA claims the same. SPAM as a whole claims to desire a "ceremonial monarch" (but the "M" has been unwilling to desist from claiming a trial or exile is the only way out for the present monarch). RNA would become a true "national" army, which, not surprisingly, it already thinks it is.

It is important to interject RNA into the discussion, because the shape of any successor organization was a major sticking point in the previous 2003 round of ceasefire talks. SPAM seems to think this institution will simply agree to dissolve itself without discussions of what this entails.

That this will not happen was put to the Maoists directly in 2003, but they were as unwilling then to grapple with the complexities thus raised as they appear to be now. Yet the growing stratum of combat-tested, politically astute officers is not simply going to go as lambs to the slaughter.

Thus a great deal more thought is required upon the part of all sides. This will not take place as long as SPAM persists in its present course.
